Clin- ics are also required to qualify as outpatient surgical cen- ters; abortion is an outpa- tient surgical procedure. The law was challenged by abortion rights groups and Planned Parenthood on grounds a woman's right to abort is thwarted wherever doctors lack privileges. Un- der the law most Texas abortion facilities would be closed; a similar Missis- sippi law closes the state's only clinic. Texas argues — successfully so far — that it is nothing but good stan- dard medical practice to expect practicing physi- cians to prove their compe- tence through having ad- mitting privileges — this is what privileges con- note. Texas was upheld in the district court and on appeal to the 5th Cir- cuit Court of Appeals. The abortionists have appealed to the Supreme Court and the court has agreed to hear the case. The issue is not clinics closing. Nothing in the law prevents doctors from ob- taining the privilege to ad- mit patients to a hospi- tal in their area. The in- competence of the docs may prevent it; medical in- competence would be the most common reason for a patient needing admis- sion following an abor- tion. Any competent doc- tor can get privileges any- where — the hospital makes money on each ad- mission. But the principal argument for abortion on demand — in 1973 and to- day — is the prevention of death and disease from so-called back alley abor- tions. Yet the incidence of infection, sterility, and death to post-abortive women is unchanged since the procedure was legal- ized by the Warren Court. The Texas and Mississippi laws address that anom- aly by requiring only com- petent doctors to perform the procedure. This is in sharp contrast to Califor- nia — home of the most abortions and the high- est per capita rate of abor- tion in the nation — where abortions performed by non-doctors are now au- thorized. Will anyone guess where the most com- plications occur? The crux of the le- gal case will be the Casey Standard, a proved-to-be unworkable compromise emerging from a 1992 case striking down a Pennsyl- vania law. The court held that states could restrict abortions, but only if the restrictions were not im- posing "undue burden" on women. The lawsuits claim the laws in ques- tion establish an undue burden. The standard has never been defined and — until now — the Supreme Court has refused to ad- dress it except to allow state bans on partial birth abortion. President Obama vetoed a federal law ban- ning the practice and has vowed to do it again. The crux of the Godly case is quite different. These laws are designed to ensure a woman's safety. Yes, they are adopted by legislatures determined to lessen the carnage of abor- tion across the board, but reality is the incidence of infection or other life threatening complications remain unchanged be- cause most good doctors prefer to practice life sav- ing medicine; this is fruit of the pro-life movement. It is the reason states like California find themselves so short of doctors will- ing to abort babies they permit non-doctors to do what cannot legally be done to animals by any- one but a veterinary doc- tor. The doctors who can- not make a decent living are left with their patients — mother and child — at their mercy. Our God came in hu- man form that we might have abundant life — ev- ery life has a value and destiny all its own. These laws save the lives of the mothers even if they deny life for their children. Back in the secular arena, noth- ing could be more reason- able than requiring a stan- dard of care that is axiom- atic for any other medical procedure. I am not innocent. At age twenty I helped two friends obtain abortions years before Roe v Wade. The babies were not mine but my highest value was having your friends' back. I found a doctor, borrowed money, and did everything but have the abortions my- self. When I met Jesus in 1970 He did not rebuke me for 1968. He did guide me into a church that prac- ticed the ancient rite of confession. When I knelt I heard Him audibly. All He said was, "Don't forget about the abortions." In that instant of absolution I knew two things — abor- tion is the taking of inno- cent human life without excuse, and I dared not judge another as I have not been judged. The good news is we have a chance to whittle away at the abortion colos- sus in these cases before the Supreme Court. The better news is we Chris- tians are God's Body, not His Brain. While we fight the scourge of abortion we had better recall His Word to judge not lest we our- selves be judged. Supreme Court Justice Antonin Scalia said Saturday the idea of religious neutral- ity is not grounded in the country's constitutional traditions and that God has been good to the U.S. exactly because Ameri- cans honor him. Scalia was speaking at a Catholic high school in the New Orleans suburb of Metairie, Louisiana. Sca- lia, who was appointed by President Ronald Reagan in 1986 is the court's lon- gest serving justice. He has consistently been one of the court's more conservative mem- bers. He told the audience at Archbishop Rummel High School that there is "no place" in the country's constitutional traditions for the idea that the state must be neutral between religion and its absence. "To tell you the truth there is no place for that in our constitutional tra- dition. Where did that come from?" he said. "To be sure, you can't favor one denomination over another but can't favor re- ligion over non-religion?" He also said there is "nothing wrong" with the idea of presidents and others invoking God in speeches. He said God has been good to America because Americans have honored him. Scalia said during the Sept. 11 attacks he was in Rome at a conference. The next morning, af- ter a speech by President George W. Bush in which he invoked God and asked for his blessing, Scalia said many of the other judges approached him and said they wished their presidents or prime min- isters would do the same. "God has been very good to us. That we won the revolution was ex- traordinary. The Battle of Midway was extraor- dinary. I think one of the reasons God has been good to us is that we have done him honor. Unlike the other countries of the world that do not even in- voke his name we do him honor. In presidential ad- dresses, in Thanksgiv- ing proclamations and in many other ways," Scalia said. "There is nothing wrong with that and do not let anybody tell you that there is anything wrong with that," he added. Scalia's comments Sat- urday come as the court prepares to hear argu- ments later this year in a case that challenges part of President Barack Obama's health care law and whether it adequately shields faith-based hospi- tals, colleges and chari- ties from having to offer contraceptive coverage to their employees. Scalia is often a light- ning rod for controversy on the court. In December he came under fire for comments he made during an affir- mative action case, ques- tioning whether some black students would benefit from going to a "slower-track school" in- stead of Texas' flagship campus in Austin.
