Thefollowingdefendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney's Office: RecentState/Local Prison Commitments: People vs. Daniel Bryan Kelly, Jr., Felon in Posses- sion of a Firearm Brief history: Cal Fire ob- served the Defendant driv- ing erratically on Antelope Boulevard. A traffic stop was conducted and he gave consent to search his vehi- cle. During the search, a loaded handgun and addi- tional ammunition was lo- cated in the center console. The Defendant was on Post Release Community Super- vision based upon prior convictions. Sentenced to 3 years in state prison People vs. Ronnie Bud Davis, Felon in Possession of a Firearm; Vehicle Theft Brief history: Defendant was originally granted probation for the Vehicle Theft. He violated his pro- bation and was sentenced to 16 months in county jail. While released from county jail, but on Community Su- pervision, Probation con- ducted a search of the De- fendant and his vehicle. At that time, he was in posses- sion of a loaded .25 caliber semi automatic firearm. Sentenced to a total of 2 years in state prison People vs. Danny Ray White, Attempted Crimi- nal Threats; Burglary; Re- sisting Executive Officer Brief history: Defendant was attempting to shoplift bottles of alcohol from Safe- way in Corning. When con- fronted by an employee, the Defendant shoved the em- ployee and refused to coop- erate. When pressured, De- fendant pulled a box cutter from his pocket and ex- tended the blade. The De- fendant and two other in- dividuals broke into the former home of a Sheriff's Department Deputy, steal- ing various items. The De- fendant was identified by a neighbor as being involved and stolen property was lo- cated in Defendant's vehi- cle. The Defendant was ini- tially granted probation in this matter. The Defendant was initially contacted as the result of a minor traf- fic accident. During the in- vestigation of the accident, controlled substances were located in Defendant's ve- hicle. When the CHP offi- cer attempted to take De- fendant into custody, De- fendant fought with the officer. The officer suffered cuts and abrasions to both elbows and one knee. The Defendant was originally granted probation in this matter. Sentenced to a total of 16 months in state prison Recent County Jail Commitments: People vs. Lanae Nicole Toerpe, Child Abuse and Driving Under the Influ- ence; Child Abuse Brief history: The Defen- dant was originally granted probation for driving under the influence with her chil- dren in the car. She violated her probation by commit- ting the offenses. Despite having been placed on pro- bation just a year earlier, the Defendant again drove under the influence and with her children in the car. In the present offense, the Defendant drove off the roadway and crashed into an oak tree. Sentenced to 5 years of formal probation, Adult Felon Drug Court, 7 years and 4 months in state prison suspended, 150 days in Tehama County Jail and community service People vs. James Benja- min Stout, Welfare Fraud and Presentation of False Claim Brief history: The Defen- dant was working as an in home health care provider for an individual. The in- dividual died on October 10, 2014, but the Defendant continued to submit time cards for several months after the death of the indi- vidual. The Defendant was paid $1,676.75 due to his fraudulent conduct. Sentenced to 3 years of formal probation, 180 days in Tehama County Jail, stip- ulated to restitution and community service. People vs. Michael Dwayne Shomer, Domestic Violence Brief history: The De- fendant and the victim are boyfriend and girlfriend and live together. A ver- bal argument turned into a physical altercation when the Defendant jumped on top of the victim, slammed her into a wall, smacked her in the face and kicked her in the ribs. The victim had vis- ible injuries that were con- sistent with her description of the incident. Sentenced to 3 years of formal probation, 120 days in the Tehama County Jail and community service. People vs. Kody Benja- min Simon, Domestic Vio- lence Brief history: The De- fendant and the victim are boyfriend and girl- friend and live together. Neighbors called the po- lice about the victim crying on the porch of her apart- ment. Law enforcement re- sponded and contacted the Defendant and the victim, who both denied that any sort of physical altercation occurred. The victim later re-contacted the police, tell- ing them that the Defen- dant had choked her and cut her hand with a knife. She did have a small cut to her hand. Sentenced to 5 years of formal probation, credit for time served in Tehama County Jail and community service People vs. Kalie Rae Ev- ans, Transportation for Sale of a Controlled Substance, Possession for Sale of a Con- trolled Substance Brief history: The De- fendant was out of custody from Tehama County Jail on an ankle monitor. Three hours after being released from custody, she was con- tacted by the local narcot- ics task force. She was in possession of a quantity of methamphetamine and ad- mitted to selling metham- phetamine. Her phone had evidence of sales of narcot- ics. Sentenced to 3 years of formal probation, 7 years in prison suspended, 270 days in Tehama County Jail and community service Upcoming Court Dates -Trials, Preliminary Hearings (PX) & Pre Trial Conferences (PTC): People vs. James Joseph Pulizzano, Attempt, Will- ful, Deliberate and Premed- itated Murder (2 counts), with Allegation Use of Fire- arm, (2 counts), Possession of a Firearm by a Felon, As- sault with a Firearm with Allegation, Use of Fire- arm (2 counts), Criminal Threats. Brief history: The Defen- dant and the Defendant's girlfriend were arguing. The Defendant pulled out a revolver and started shoot- ing at her. The victim's son was in the direct line of fire. The Defendant missed both victims but riddled the house with shots. The De- fendant threatened to kill the girlfriend. The Defen- dant is a felon. PPX: January 4, 2016 at 10 am in Department 1 PX: January 5, 2016 at 1:30 pm in Department 2 People vs. Quentin Ray Bealer, Murder Brief history: The De- fendant was arrested and charged with the murder of a 14 year old victim who had been reported missing when she never returned home from school. Officers located the victim's body two days later. TBJ: Vacated. Defendant Plead guilty. SENTENCING: Febru- ary 12, 2016 at 1 pm (De- partment to be determined) People vs. Poly Duenas Sanchez, Lucio Nenecia Madera, Gabino Madera, Murder with Special Alle- gation, Personal and Inten- tional Discharge of a Fire- arm, GBI, Conspiracy to Commit a Crime with Spe- cial Allegation, Personal and Intentional Discharge of a Firearm, GBI. Brief history: The Vic- tim had met up with the three Defendants regarding money that was allegedly owed to the victim. During this confrontation the vic- tim was chased down and shot twice with a shotgun. The victim died as a result of his injuries. TBJ: March 2, 2016 at 1:30 pm (Department to be determined) People vs. Alan Duane Doulphus Jr., Chase Alan Doulphus: Murder, special allegation felony murder, personal and intentional, use of a firearm, assault with a firearm, false impris- onment by violence, trans- portation of marijuana. Brief history: The defend- ants went to a residence that contained a marijuana grow. The defendants con- fronted the victim and two other men who were at the residence and ordered them to the ground at gunpoint. The defendants proceeded to tie up the victim and the two men with zip ties and duct tape. The victim was able to free himself and at- tempt to flee the residence but was shot several times by the armed defendants. The victim eventually suc- cumbed to his injuries. De- fendant's vehicle was lo- cated a short time later and a vehicle pursuit followed. Defendant's were eventu- ally apprehended and taken into custody. Inside the ve- hicle officers located a large amount of marijuana. Brief history: The Defen- dant is charged with shoot- ing and killing his ex-wife and her father, and shoot- ing a bystander. PX: January 26, 2016 at 1:30 pm in Department 2 People vs. William Fos- ter, Derek Hale, Garrett Lenardo, Zachary Thorn- ton and Robert Beaugrand, attempted murder Brief History: What be- gan as a marijuana deal re- sulted in kidnapping, rob- bery and one individual with a gunshot wound. PTC: December 14, at 1:15 pm in Department 3 People vs. Anthony Na- hinu, attempted murder Brief History: The Defen- dant is charged with shoot- ing the minor victim. PTC: December 18, at 11 am in Department 3 TBJ: January 6, at 1:30 pm in Department TBD People vs. David Hast- ings, Grand Theft of Per- sonal Property; First De- gree Residential Burglary; Possession of Burglar's Tools; First Degree Resi- dential Burglary, 4 counts; Grand Theft of Personal Property, 3 counts; Grand Theft; Identity Theft, 2 counts; Possession of a Fire- arm by a Felon; Possession of Ammunition; Receiving Stolen Property, 9 counts; Petty Theft. Brief history: The vic- tim's vehicle was broken into and several personal items were stolen includ- ing a wallet. The following day, the victim's bank ac- count was missing $1,300. It was later found the De- fendant's cell phone bill had been paid with the ex- act same amount by the vic- tim's checking account. The Defendant denied. The vic- tim's home was burglarized while on vacation. Neigh- bors had taken pictures of the vehicle and the driver that was at the home. While officers contacted the De- fendant on other matters, they discovered several of the victim's items within the Defendant's vehicle. The Defendant was the suspect in various burglaries within the area. Several items of stolen property were found on the Defendant's person while being contacted in re- gards to other cases.
