Thursday, March 22, 2012 – Daily News COURT ROUND-UP The following defen- dants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney's Office: —————— Recent State Prison Commitments • Jennifer Marie Tirri was sentenced to seven years and eight months in state prison for driving With a 0.08 percent Blood Alcohol Content causing injury, special allegation- great bodily injury-elderly victim, leaving the scene of an accident. Tirri was driving on I-5 when she lost control of her vehicle and struck another vehicle driven by the victim. The victim's vehicle spun out of control and landed upside down. Tirri then exited her vehi- cle and fled the scene on foot. A short time later an officer was able to locate Tirri who appeared to be under the influence of alcohol. Tirri was arrested and taken into custody. The victim was taken to the hospital with serious injuries. • Robert Martin McNeese was sentenced to six years in state prison for transportation of a con- trolled substance, special allegation-prior strike. McNeese was original- ly granted formal proba- tion. He violated his proba- tion when he failed to appear for scheduled appointments as required. • Ricky Tosh Eusted was sentenced to four years in state prison for evading an officer, willful disregard, special allega- tion-prior felony. A deputy attempted to conduct a traffic stop on a vehicle driven by Eusted. When Eusted failed to stop a pursuit ensued. Eusted sped away at a high rate of speed and ran through sev- eral stop signs. The pursuit continued until Eusted Welcome to informacion en Español, Llame Alex Para mas eventually came to a stop and the passenger jumped out of the vehicle and fled on foot. Eusted was ordered out of the vehicle and taken into custody. • Martin Ortega Perez was sentenced to four years in state prison for failure to appear on own recognizance, special alle- gation-offense while on bail or O.R. Perez was released from custody on his own recog- nizance and failed to appear in court as ordered. • Zackery Cary Norbury was sentenced to four years in state prison for grand theft firearm, special allegation-prior strike. Victim reported a firearm and money had been stolen from his resi- dence. After investigating the incident the deputy learned Norbury may have been involved in the theft and may have the firearm hidden in the garage at his residence. After receiving consent from the owner of Norbury's property the deputy conducted a search of Norbury's garage and located the stolen firearm. • Brandon Allan Bacon was sentenced to three years and four months in state prison for attempted first degree burglary, unlawful driving or taking of a vehicle, carrying a dirk or dagger. Deputies received a report that the victim's home was burglarized and their vehicle had been stolen. After investigating the incident deputies con- tacted Bacon who was found in possession of a fixed blade knife con- cealed in his clothing. Bacon was also found to be wearing shoes that matched the shoe prints found at the scene of the burglary. • Edgar Ramiro Gaona was sentenced to three years in state prison for transportation of metham- phetamine. An officer conducted a traffic stop on a vehicle driven by Gaona. Upon contacting Gaona the offi- cer observed a strong odor of air fresheners coming from the vehicle. The offi- cer deployed his K-9 and conducted a search and located methamphetamine hidden inside the vehicle. • Deborah Lynn Hen- drie was sentenced to three years in state prison for possession of a controlled substance, special allega- tion-prior felony. Hendrie was originally granted formal probation. She violated her probation when she failed to report to the probation department upon her release from cus- tody, failed to complete her community service and admitted to drinking alco- hol. • David Lyn Pot was sentenced to three years in state prison for petty theft with a prior. Pot entered a local gro- cery store, filled a cart full of groceries and proceeded to exit the store without paying for the items. • Christina Jeanette Hathorne was sentenced to two years in state prison for possession of a con- trolled substance. Hathorne was originally granted formal probation. She violated her probation when she tested positive for methamphetamine and marijuana, failed to com- plete her community ser- vice, failed to complete her drug and alcohol treatment program and has violated the law several times since being granted probation. • Laura Marie Miller was sentenced to two years in state prison and Tiffany Renee Knapp was sen- tenced to two years formal probation for second degree commercial bur- glary. Miller located a receipt in the parking lot of a busi- ness. Miller then entered the business and obtained the items that were listed on the receipt, conceals them and exited the store without paying. Miller and Knapp then returned to the store with the receipt and merchandise in an attempt to return them for cash. • Mario Alfaro Escobe- do was sentenced to 16 months in state prison for counterfeit seal. A witness observed Escobedo drive through a parking lot, collide into another vehicle and flee the scene. When officers arrived at the location they contacted Escobedo and found him in possession of a fraudulent resident alien card and fraudulent social security card. Recent County Jail Commitments • Claudio Ramirez was sentenced to 180 days in Tehama County Jail for evading an officer, willful disregard. An officer recognized Ramirez driving a vehicle and believed he may have been driving on a suspend- ed license. As the officer followed behind Ramirez' vehicle in an attempt to run the license plate through dispatch, Ramirez sped away at a high rate of speed driving recklessly through the streets. The officer pursued Ramirez until he eventually lost sight of the vehicle and the pursuit was terminated. • Richard Charles Wright was sentenced to 120 days in Tehama Coun- ty Jail for maintaing place for selling or using con- trolled substance, posses- sion of concentrated cannabis. An officer conducted a traffic stop on a vehicle driven by Wright. The offi- cer's K-9 alerted on the vehicle and a search was conducted. The officer located a large amount of marijuana in the vehicle. A search warrant was then obtained for defendant's residence where officer's located several marijuana plants and processing material. • Sharleta Geaninne Durham was sentenced to 120 days in Tehama Coun- ty Jail for aid by misrepre- sentation. Durham had submitted forms to apply for general assistance and food stamps. On these forms Durham made false state- ments and signed them under penalty of perjury. As a result, Durham received money that she was not entitled to. • Robert William Turner was sentenced to 90 days in Tehama County Jail for possession of marijuana for sale. A deputy conducted a traffic stop on a vehicle driven by Turner. During a consent search of the vehi- cle the deputy located bags of marijuana. • Kenneth Wayne Jones was sentenced to 90 days in Tehama County Jail for possession for sale of a controlled substance. Deputies received a report of a suspicious vehi- cle. Upon arriving at the reported location deputies contacted Jones and obtained consent to search which yielded metham- phetamine. Recent Proposition 36 Commitments Note: All cases wherein a defendant is sentenced per the terms of Proposi- tion 36 are not at the request of the Tehama County District Attorney's Office. Per the require- ments of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposi- tion 36, only upon a third drug related probation vio- lation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney's Office contends that each crimi- nal case is unique and that in certain, specific, cases a defendant should be sen- tenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non- compliance with either previous grants of proba- tion or previous grants of drug treatment, a state prison sentence should properly be imposed. • Christopher Allen Ramos was sentenced to Prop. 36 probation for transportation of a con- trolled substance. An agent contacted Ramos on the streets after recognizing him to be a wanted parolee. A search was conducted and the agent located methamphet- amine and syringes in Ramos' backpack. Upcoming Court Dates -Trials, Prelimi- nary Hearings (PX) & Pre Trial Conferences (PTC) • Joseph Dailey Froome and Daniel Miguel Ludwig will appear in court at 8:30 a.m. on March 28. Both are facing charges of cultivat- ing marijuana; possession of marijuana for sale. Froome faces the addition- al charge of eight counts of money laundering. Agents served a search warrant at the defendant's warehouse off of Baker Road in Red Bluff. Inside they found over 400 mari- juana plants. TIDE agents also located over 30 pounds of processed mari- juana.
