Pursuant to a resolution entitled "Resolution Declaring Intention to Finance Installation of Seismic Strengthening Im- provements, Electric Vehicle Charging Infrastructure and Other Authorized Improvements and Other Related Matters," adopted on October 9, 2015 (the "Additional Authorized Improve- ments Resolution of Intention"), the Commission of the California Statewide Communities Devel- opment Authority ("California Communities") has determined with respect to its existing CaliforniaFIRST program that it would be convenient, advanta- geous, and in the public interest to designate an area, which shall encompass the entire geo- graphic territory within the boundaries of the counties, and cities in Los Angeles County, listed at Appendix 1 of the Addi- tional Authorized Improvements Resolution of Intention (collec- tively, the "Covered Jurisdic- tions," and each a "Covered Ju- risdiction"), within which Cali- fornia Communities and proper- ty owners within the Covered Ju- risdictions may enter into con- tractual assessments to finance the installation of seismic strengthening improvements that are permanently fixed to residential, commercial, indus- trial, agricultural, or other real property including, but not limit- ed to, the seismic strengthening of cripple walls and sill plate an- chorage of light, woodframed buildings, electric vehicle charg- ing infrastructure that is perma- nently fixed to residential, com- mercial, industrial, agricultural, or other real property and all other improvements authorized from time to time thereafter (collectively, the "Additional Au- thorized Improvements"), in each case pursuant to Chapter 29 of Part 3 of Division 7 of the Streets & Highways Code of the State of California ("Chapter 29"). The Additional Authorized Im- provements Resolution of Inten- tion, including Appendix 1 there- to, is on file with the Secretary of the Commission, and refer- ence is made thereto for the particular provisions thereof. The Additional Authorized Im- provements Resolution of Inten- tion ratifies and incorporates all the resolutions that the Com- mission has adopted, and other actions taken in furtherance of those resolutions that the Com- mission has taken, with respect to the CaliforniaFIRST program except as superseded by the Ad- ditional Authorized Improve- ments Resolution of Intention. 2. Report. Pursuant to the Addi- tional Authorized Improvements Resolution of Intention, the Commission ordered prepara- tion of a report that amends and restates the existing report for the CaliforniaFIRST program (as amended and restated, the "Amended and Restated Pro- gram Report") at or before the time of the public hearing that contains all the matters descri- bed in Sections 5898.22, 5898.23, 5899 and 5899.2. 3. Contract. Chapter 29 author- izes (or may in the future au- thorize, as applicable) California Communities and property own- ers within the Covered Jurisdic- tions to enter into contractual assessments to finance the in- stallation of Additional Author- ized Improvements. The Amend- ed and Restated Program Report will contain a draft contract (the "Contract") specifying the terms and conditions that would be agreed to by California Com- munities and property owners within the Covered Jurisdictions. 4. Financing Provisions. The Commission determined in the Additional Authorized Improve- ments Resolution of Intention that it is in the public interest for California Communities to fi- nance the installation of Addi- tional Authorized Improvements in the Covered Jurisdictions. Un- der Chapter 29, California Com- munities may issue bonds pur- suant to Chapter 29, or enter in- to other financing arrangements authorized by Chapter 29, that are payable by contractual as- sessments and California Com- munities may advance its own funds to finance work to be re- paid through contractual as- sessments, and may from time to time sell bonds, or enter into other financing arrangements authorized by Chapter 29, to re- imburse itself for such advan- ces. 5. Public Hearing. A public hear- ing will be held at 10:00 a.m., on November 19, 2015, at 1100 K Street, Sacramento, CA 95814, for the purposes of allowing in- terested persons to object to or inquire about the matters pro- posed in the Additional Author- ized Improvements Resolution of Intention or any of their par- ticulars. The public hearing may be continued from time to time as determined by the Commis- sion for a time not exceeding a total of 180 days.
