Thursday, March 8, 2012 – Daily News COURT ROUND-UP The following defendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attor- ney's Office: —————— Recent State Prison Commit- ments • William Daniel Bishop was sentenced to six years and eight months in state prison for (NCR81345): unlawful driving or taking of a vehicle; (NCR81355) unlawful driving or taking of a vehicle; (NCR81501)- PC12020(a)(4)-carrying a dirk or dagger; (NCR82002)-first degree burglary; (NCR82009); burglary. (NCR81345)-Victim's vehicle was stolen and found abandoned in the parking lot of a convenience store. An officer obtained the store surveillance video and observed Bishop driving the stolen vehicle. (NCR81355)-An officer observed Bishop driving a stolen vehicle and conducted a traffic stop. As the officer contacted Bishop a struggle ensued until the officer was able to gain control of Bishop and place him into cus- tody. (NCR81501)-Officers con- tacted Bishop and arrested him on outstanding warrants. As the offi- cers conducted a search they locat- ed a knife and a hypodermic syringe in Bishop's pocket. (NCR82009)-Bishop had stolen victim's debit card and attempted to use it to purchase items. (NCR82002)- Bishop and a com- panion had brandished a knife at the victim and ordered him to hand over all his cash. • Robert Alexander Ussery was sentenced to four years and eight months in state prison for first degree residential burglary; forgery. Victim reported his residence had been burglarized. Upon inves- tigating the incident deputies con- tacted Ussery at his residence and located the items that had been reported stolen. Ussery was then arrested and taken into custody. Ussary was originally granted for- mal probation. He violated his probation when he failed to keep in contact with probation, failed to complete his drug and alcohol treatment program and was arrest- ed and convicted in NCR82694. • David Robert Fleckenstein was sentenced to three years and eight months in state prison for possession of a controlled sub- stance;- possession of a controlled substance. Fleckenstein was originally granted formal probation on both cases. He violated his probation when he failed to appear in court as ordered and admitted using heroin while on probation. • Benjamin Joseph Green was sentenced to three years in state prison for unlawful driving or tak- ing of a vehicle. Green observed victim leave her vehicle running with the keys in the ignition while she entered a store. As the victim entered the store Green jumped in the vehicle and drove away. Green was even- tually located when he was found asleep inside the stolen vehicle that was parked in front of a busi- ness. • Michael Charles Meier was sentenced to three years in state prison for failure to register: initial registration after address change, special allegation-prior felony. An investigator contacted Meier who was observed panhan- dling near a freeway. Upon run- ning a records check on Meier the investigator was advised he was a sex registrant and had failed to register as required. • James Danny Boughan was sentenced to three years in state prison for assault with a deadly weapon. Boughan arrived at victim's residence and became angry when he saw both victims consuming alcohol and cursing. A fight ensued which led to Boughan grabbing a knife, stabbed one of the victims and threw the other victim to the ground. • Garr Jessie Midgett was sen- tenced to two years and eight months in state prison for receiv- ing stolen property, possession of a deadly weapon. Midgett was originally granted formal probation. He violated his probation when he failed to keep in contact with his probation offi- cer, failed to complete his alcohol and drug treatment program and tested positive for marijuana. • David Paul Fernandez was sentenced to two years in state prison for evading an officer, will- ful disregard. Fernandez was originally granted formal probation. He vio- lated his probation when he found in possession of ammunition. • Heather Noell Earle was sen- tenced to two years in state prison for transportation of a controlled substance. Earle was originally granted formal probation. She violated her probation when she drove a vehi- cle while under the influence of alcohol and then collided into another vehicle injuring the driver. • Donald Nicholas Whatley was sentenced to four years and eight months in state prison for carrying a dirk or dagger. Officers contacted Whatley after he was observed looking into vehicles. The officers were advised Whatley had warrants for his arrest and he was taken into custody. During a pat down search officers located three fixed blade knives concealed in Whatley's clothing. • Kimberly Colleen Oslin was sentenced to 16 months in state prison for possession of ammuni- tion. Oslin was originally granted formal probation. She violated her probation when she tested positive for methamphetamine. • Brandon Rene Fitzgerald was sentenced to 16 months in state prison for aid by misrepresenta- tion. Fitzgerald was originally grant- ed formal probation. She violated her probation when she failed to keep probation informed of her current contact information, tested positive for methamphetamine and failed to report to jail to serve out her sentence. • Brian Michael Anderson was sentenced to 16 months in state prison for unlawful driving or tak- ing of a vehicle. A deputy conducted a traffic stop on a vehicle driven by Ander- son. When the deputy learned the vehicle had been reported stolen defendant was arrested and taken into custody. Recent County Jail Commit- ments • Bruce Bosworth was sen- tenced to 365 days in Tehama County Jail for driving while hav- ing a 0.08 percent or higher Blood Alcohol-three priors. Officers received a report of a possible DUI driver. Upon arriv- ing at Bosworth's location an offi- cer contacted Bosworth who was sitting in the drivers seat of his parked vehicle. The officer observed the odor of alcohol emit- ting from Bosworth's breath and determined Bosworth was driving under the influence of alcohol. Bosworth was arrested and taken into custody. • Joshua David White was sen- tenced to 210 days in Tehama County Jail for grand theft auto with a prior. White and victim became engaged in a verbal argument which escalated when White hit the victim in the mouth with his elbow and chocked her. • Jeremy Duane Erickson was sentenced to 180 days in Tehama County Jail for first degree resi- dential burglary. A deputy contacted Erickson at his residence after it was reported he may be responsible for burglar- izing victim's residence. After receiving consent the deputy searched the residence and located some of the stolen items. • James Dominic Arano was sentenced to 365 days in Tehama County Jail for unlawful firearm activity. A warden observed Arano walking down a road carrying a rifle. The warden made contact with Arano and discovered Arano had illegal bullets in the magazine of his rifle. • Jon Paris Holzhauer was sen- tenced to 120 days in Tehama County Jail for vandalism over $400 damage. Officers received information that Holzhauer was involved in the vandalism that occurred through- out the city. Officers contacted Holzhauer at his residence were they determined he was responsi- ble for the some of the graffiti that was found on businesses and per- sonal property throughout Red Bluff. • Martin Ray Hulseman was sentenced to 120 days in Tehama County Jail for transportation of a controlled substance. Hulseman was originally granted formal probation. He vio- lated his probation when he failed to contact his probation officer. • Bonnie Lee Clinton was sen- tenced to 90 days in Tehama County Jail for grand theft of per- sonal property. Clinton's companion was a caretaker for Clinton and was receiving money from the county for her services. Investigators dis- covered that over a period of sev- eral years the companion was receiving the checks from the county and handing them over to Clinton in exchange for some of the cash. • Michael James Taylor was sentenced to 90 days in Tehama County Jail for possession of Con- centrated Cannabis. An officer conducted a traffic stop on a vehicle driven by Taylor. Upon contacting Taylor the officer observed the odor of marijuana coming from the vehicle. The offi- cer obtained a K-9 and conducted a search and located several bags of marijuana inside the vehicle. • Danielle Corina Nunez was sentenced to 90 days in Tehama County Jail for unlawful driving or taking of a vehicle. An officer located Nunez dri- ving a vehicle that had been reported stolen and proceeded to conduct a traffic stop. Upon con- tacting Nunez the officer observed the ignition in the vehicle had been punched as well as locating a screwdriver on the seat next to Nunez. Recent Proposition 36 Commitments Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sen- tenced to confinement time in jail or prison. Instead, the court must place defendant on proba- tion and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation vio- lation may the court impose confinement time. In the event the defendant violates a non- drug related term of probation the court may then elect to sen- tence defendant to jail or prison. The Tehama County District Attorney's Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treat- ment and jail time. Investigators located Shoffner at a residence while serving a search warrant. On the property investigators located numerous marijuana plants. • Brandon James High was sentenced to Prop. 36 probation for possession of a controlled sub- stance. A deputy observed High vio- late a traffic law while riding his bicycle. The deputy contacted High and conducted a consent search and located methampheta- mine. Upcoming Court Dates -Tri- als, Preliminary Hearings(PX) & Pre Trial Conferences(PTC) • Laura Lynn East will appear in court for a preliminary hearing at 9 a.m. on April 12 in Dept. 2. She is facing the charges of child abuse, driving under the influence of alcohol and/or drugs, hit-run driving. Based upon an investigation conducted by the California High- way Patrol, East was driving a school bus full of kids when she began driving erratically. It was reported East backed the school bus into a sign, nearly drove the bus off the shoulder of the road and continued swerving on the road while stopping at the bus stop locations to pick up children.
