The Cumberland County Public Health Department is responsible for implementation and promotion of the new state law that bans smoking in enclosed areas of almost all restaurants and bars. Smoking will be allowed in unenclosed areas, GHÀQHGDVDSDWLRZLWKDVROLGURRIEXWQRZDOOV The law bans smoking in lodging establishments if the business prepares and serves food or drink. A lodging establishment may designate 20 percent of its guest rooms as smoking rooms. All restaurants, bar, and lodging establishment managers or owners subject to the new law will be required to post visible no-smoking signs in various locations throughout their facility and to remove indoor ashtrays along with other items used for smoking. Managers or owners are also responsible for directing a person who is smoking to extinguish the cigarette, cigar, or other lighted item. If a smoker refuses to extinguish the lighted product after receiving verbal or written notice from the manager or RZQHUDODZHQIRUFHPHQWRIÀFLDOFDQLVVXHDÀQHRI XSWR,I a manager or owner of a restaurant, bar, or lodging establishment does not comply with the new law, the local health director could LVVXHDÀQHRI XSWR7KHKHDOWKGLUHFWRUZRXOGÀUVWKDYHWR LVVXHWZRZDUQLQJVWRWKHHVWDEOLVKPHQWLQRUGHUWRLVVXHWKH ÀQH If you observe someone violating the law, please notify the establishment's owner or manager. If you observe a restaurant, bar, or lodging establishment that is subject to the law violating the law, please contact your local health director. New Law Bans Smoking The Fayetteville and Cumberland County Community Development Departments are conducting a survey as part of an analysis of fair housing issues in the county and city.
