ByBrianMelley The Associated Press LOS ANGELES A judge's decision to release videos showing police killing an unarmed California man doesn't mean it will be eas- ier for the public to get such footage. In fact, it shows police will do all they can to keep recordings secret. Even after U.S. District Judge Stephen V. Wilson ruled Tuesday in favor of news media companies that the First Amendment required unsealing the evi- dence in a lawsuit, the city of Gardena took its aggres- sive fight to shield the foot- age from view to a higher court. "We have serious privacy concerns as it relates to the release of police videos in general," Gardena Police Chief Ed Medrano said in a statement after the ruling. "Although the video has been released, we are still moving forward with our appeal because we are con- cerned about the broader implications of this deci- sion." The ruling comes amid a broader debate about whether public accountabil- ity requires disclosure of video of officers using force recorded by a growing num- ber of cameras worn on po- lice uniforms and mounted in their cruisers. Police want to keep footage under wraps as evidence exempt from disclosure and to pro- tect the privacy of people caught on camera. Video showing the fa- tal encounter with Ricardo Diaz-Zeferino was released after an attorney for The Associated Press, the Los Angeles Times and Bloom- berg argued the videos should be unsealed because of the intense public scru- tiny of police shootings na- tionwide and the public's in- terest in knowing what hap- pened. Wilson agreed, saying people should be able to see why the city paid $4.7 mil- lion to settle a lawsuit with Diaz-Zeferino's family and another man wounded in the shooting "only strength- ens the public's interest in seeing the videos." He also said any privacy concerns were outweighed because the victims wanted the foot- age released. The city of Gardena had argued that the videos were protected from disclosure by an exemption in the Cal- ifornia Public Records Act, and that releasing them could harm the officers and dissuade other cities from using video if they thought it would be broadcast pub- licly. Peter Scheer, execu- tive director of the First Amendment Coalition, said the ruling could have a positive influence on pub- lic policy discussions over what can be disclosed, in part because video tended to support the reason Gar- dena police cited for shoot- ing Diaz-Zeferino. By Fenit Nirappil The Associated Press SACRAMENTO California extended its drought-in- spired purge of idyllic em- erald lawns from new de- velopments, with state of- ficials voting Wednesday to adopt more stringent wa- ter limits on landscapes for new homes and businesses. The rules approved by the California Water Com- mission would essentially eliminate grass from new office and commercial buildings and reduce turf at new homes from a third of landscaped area to a quarter. The rest of the land- scapes can feature rocks, shrubs or low water-using plants such as lavender and jasmine. The Department of Wa- ter Resources estimates fu- ture residential and com- mercial lawns will use nearly a third less water under the new standards. New subdivisions and homes won't necessarily be devoid of lawns, how- ever. Developers of tradi- tional-looking landscapes can comply if the homes or businesses are hooked up to recycled water from showers and toilets. Californians won't have to rip out existing lawns unless they are going through major home ren- ovation that requires gov- ernment permits. The changes are part of an update to the state's model landscape ordi- nance that was ordered by Gov. Jerry Brown as part of measures to conserve water. Local governments must adopt those rules, or something just as water- saving, by December. The state already up- dated its building stan- dards to minimize lawn watering, but the rules ad- opted Wednesday apply to more homes and require even less water. Officials at the Department of Water Resources said the build- ing standards will likely be adjusted to match its rules. Brown's administration has targeted decorative lawns as a waste of water and an easy sacrifice for conservation efforts dur- ing the ongoing, four-year drought. Regulators are encouraging residents to let their lawns go brown to help cities meet manda- tory water use reduction targets to stretch supplies if the dry spell persists. Jurgen Gramckow, who founded one of California's largest companies to grow sod for suburban land- scapes, laments the vilifi- cation of lawns as symbol- ism that will not yield sub- stantive water savings. "The beautiful green California landscape? It's history," Gramckow, pres- ident of Southland Sod Farms, said in an inter- view Wednesday. "Nobody really appreciates the envi- ronmental benefits associ- ated with lawns. Lawns are taken for granted." Some environmentalists say the state isn't going far enough because not a sin- gle drop of depleted wa- ter should be wasted on decorative lawns. Even when lush lawns are wa- tered with sink and wash- ing machine waste, drink- ing-quality water is used as a backup, said Natural Resources Defense Coun- cil policy analyst Tracy Quinn.
