Chapter 13.24 of the Tehama County Code is hereby repealed. SECTION 2. Chapter 13.24 is hereby added to the Tehama County Code to read: Chapter 13.24 PARK REGULATIONS Sections: 13.24.010 - County Park Defined. 13.24.020 - General regulations applicable to all parks. 13.24.030 - Violations and liabili- ties. 13.24.010 County Park Defined. For purposes of this chapter, the terms "county park" and "park" shall mean all of the following: Cone Grove Park, located at 24280 Cone Grove Road, Red Bluff, California; Mill Creek Park, located at 24670 Tehama-Vina Road, Los Molinos, California; Ridgeway Park, located at 19725 Ridge Road, Red Bluff, Califor- nia; River Park, located at 25340 South Avenue, Corning, Califor- nia; Simpson Finnell Park, locat- ed at 13340 Round Valley Road, Paskenta, California; Noland Park, located at 19001 Bowman Road, Cottonwood, California; Camp Tehama, located at 40550 Hwy 172, Mill Creek, California; Gerber Park, located at 520 Mariposa Avenue, Gerber, Cali- fornia; and any other real prop- erty owned and controlled by the County hereinafter dedicat- ed by the Board of Supervisors as a County park and opened for public use in accordance with state law. 13.24.020 General regulations applicable to all parks. A. No person shall re- move any material, including but not limited to dirt, gravel and vegetation, from any prop- erty used as a county park with- out the permission of the Tehama County Chief Adminis- trator or designee. B. All county parks are open for use by the general pub- lic from six (6) a.m. to eleven (11) p.m. each day, except that the Board of Supervisors may specify different open hours for any county park by resolution. C. Disposable glass beverage containers of any kind are not permitted in any county park. D. Dogs are permit- ted on a leash and only in areas designated by the county through appropriate signage. E. No vehicles may be driven in excess of ten miles per hour in any park. F. No vehicles, in- cluding motorcycles, ATV's, scooters, or other motorized ve- hicles, but excluding motorized and non-motorized wheel chairs, are allowed to be driven or parked on the lawn of any county park without the permis- sion of the Tehama County Chief Administrator or designee, or in the event of an emergency. G. In those parks hav- ing baseball / softball fields, games shall end no later than eleven (11) p.m. and all field lights shall be turned off no later than eleven-fifteen (11:15) p.m. H. Horseback riding and use of horses in a county park is limited to those areas designated by sign as open to horses and horseback riding. I. Camping is allowed only upon the approval of the Tehama County Board of Super- visors. J. Vending, including sale of food or beverages, is pro- hibited within County parks ex- cept by prior approval of the Tehama County Board of Super- visors. 1. Approval to sell food or beverages, if granted, will be conditioned upon compliance with the California Retail Food Code and county insurance re- quirements, in addition to any other conditions imposed by the Board. 2. Approval to sell alco- holic beverages, if granted, will further be conditioned upon concurrence of the Tehama County Sheriff, proof of an ap- propriate permit or license is- sued by the Department of Alco- holic Beverage Control, and pro- vision of evidence of additional liquor liability insurance, in ad- dition to any other conditions imposed by the Board. K. Reservations for any county park or park facility shall be accepted at the sole discre- tion of the county. The accept- ance of any reservation shall not be deemed to obligate the coun- ty to issue subsequent reserva- tions for the same or similar events or to the same applicant. L. No inflatable bounce houses, water slides, trampolines or similar equip- ment shall be used in any coun- ty park. M. Nothing shall be staked into lawn areas. N. No diving or swim- ming from any county park boat launch area is permitted. O. Vehicle parking at any county park boat launch area shall be in designated spaces only. P. All trash, decora- tions brought into the park by patrons, and similar items, shall be removed from the park or discarded in trash receptacles prior to the patron leaving the park. Q. No person shall de- face any structure, equipment, utilities, lawn, sidewalk, trees or vegetation in any county park. R. No person shall ig- nite, maintain, or use any fire in any place within any park facili- ty except in a barbecue cooker or other cooking device, or with- in areas designated by the coun- ty through appropriate signage. S. No person other than a peace officer in the dis- charge of their duties shall use, maintain, possess, fire or dis- charge any firearm or other dan- gerous or deadly weapon within any county park. 13.24.030 Violations and liabili- ties. A. Any person who breaks, alters or destroys any park equipment, building or fencing shall be liable for the cost of repair or replacement of such damage. B. A violation of damage. B. A violation of this chapter shall be a misde- meanor. C. The provisions of this section are cumulative, and shall not be construed to limit the county's ability to exer- cise any other rights or rem- edies that are provided by law. SECTION 3. Should any provision of this Ordinance, or its applica- tion to any person or circum- stance, be determined by a court of competent jurisdiction to be unlawful, unenforceable or otherwise void, that determina- tion shall have no effect on any other provision of this Ordi- nance or the application of this Ordinance to any other person or circumstance and, to that end, the provisions hereof are severable. SECTION 4. This ordinance shall take effect thirty (30) days from the date of its adoption, and pri- or to the expiration of fifteen (15) days from the adoption thereof shall be published at least one time in the Red Bluff Daily News, a newspaper of gen- eral circulation in Tehama Coun- ty.
