The overpass on Inter- state 20 was slick with ice Wednesday morning when the Texas Department of Criminal Justice bus left the roadway in Penwell, just west of Odessa, accord- ing to Ector County Sheriff Mark Donaldson. An earlier accident on the I-20 overpass may have contributed to the prison bus losing control, Don- aldson said. The Texas Department of Criminal Justice con- firmed the 10 deaths in a statement, adding that four prisoners and one correc- tions officer were injured. The bus driver and another corrections officer were among those killed "It's as bad as you can imagine," Odessa Fire and Rescue Battalion Chief Ka- vin Tinney told the Odessa American newspaper. "In 32 years it's as bad as any- thing I've seen." Tiffany Harston, spokes- woman for Medical Center Hospital in Odessa, said four of the injured are in critical condition and one is in serious condition. "It's with a heavy heart that we mourn the loss of those killed and injured this morning in a tragic accident," said Brad Liv- ingston, executive direc- tor of the Department of Criminal Justice. "Their loved ones will be in our thoughts and prayers." Jason Clark, a Depart- ment of Criminal Justice spokesman, said the bus was new and had been placed in service only this past summer. It was taking the inmates from the Mid- dleton prison in Abilene to the Sanchez prison in El Paso, he said. The prisoners were handcuffed together in pairs, but there were no leg restraints, said Jason He- aton, agency director for the region. Only the driv- er's seat had a seatbelt, he said. The school bus-like vehicle also does not have seatbelts on the bench-type seats where the prisoners were seated. After the accident around 7:30 a.m., the white bus came to rest on its side, next to the railroad tracks, crumpled with heavy dam- age to its front and under- carriage. By Michael Rubinkam The Associated Press Armed with a new state law, pro-gun groups are rapidly scaling up their at- tack on municipal firearms ordinances in Pennsylva- nia, with the National Ri- fle Association filing suit over gun-control measures in three cities. Philadelphia, Pittsburgh and Lancaster have "openly defied" a 40-year-old state law that forbids municipal- ities from regulating fire- arms, said Chris Cox, exec- utive director of the NRA's Institute for Legislative Ac- tion. Pittsburgh Mayor Bill Peduto said Wednesday the city "will not be deterred" by the NRA suit, contend- ing the local regulations are a sensible way to address deadly gun violence. "This should be a wake- up call for citizens across Pennsylvania," he said. "We're not taking away anyone's right to own a gun — or 10 or 20 guns. What we're saying is when a gun is lost or stolen you've got to report it. Too many peo- ple are being killed in the streets of Pittsburgh and other cities with stolen guns." Pennsylvania has long barred its municipalities from approving ordinances that regulate the owner- ship, possession, transfer or transportation of guns or ammunition. But scores of cities and towns ignored the prohibition, and gun- rights groups complained the local measures were difficult to challenge be- cause judges have ruled that plaintiffs could not prove harm. Under a state law that took effect last week, gun owners no longer have to show they have been hurt by an ordinance to win in court. The new law also allows organizations like the NRA to sue. Successful challengers can also seek le- gal fees and other costs. Philadelphia, Pittsburgh and Lancaster are fighting the new law in court, con- tending lawmakers didn't follow constitutional proce- dure for passing legislation. "It is unconstitutional, it never should have been passed, and it breaks with more than 200 years of his- tory in Pennsylvania, by al- lowing organizations with- out standing the ability to sue," Peduto said. The lawsuit filed Wednes- day against Philadelphia targets seven ordinances, including ones that require owners to report lost or sto- len firearms; prohibit guns from city-owned facilities; and ban weapons posses- sion by people subject to protection-from-abuse or- ders or who are found to pose a risk of "imminent harm" to themselves or oth- ers. Philadelphia officials have long said its measures are needed to combat gun violence that claims hun- dreds of lives each year. In 2010, the Pennsylvania Su- preme Court tossed city or- dinances that limited peo- ple to buying one gun a month and banned assault weapons, but the NRA — deemed to lack standing — lost its bid to get other city gun laws thrown out.
