The driver was not wearing his seat belt at the time of the colli- sion. According to a California High- way Patrol report, the man, who has not yet been named, was driv- ing a 1999 Ford truck around 7:25 p.m. pulling a trailer northbound on Interstate 5 in the right lane south of Sour Grass Creek at an unknown speed. The Tehama County Elections Department released numbers that included 5,889 received on vote-by-mail ballots from across the country. That accounts for 19.52 percent of the registered vote. County Clerk Bev Ross said she estimated turnout would at best be around 40 percent of those registered. The counted vote-by-mail bal- lots were 32 percent of those is- sued. Walk-in voting was ex- pected to be extremely low. If the early numbers are any indication the race, the final two years of Tehama County's 2nd District Supervisor seat could take days to decide. Appointed incumbent Sandy Bruce led her challenger Candy Carlson by one vote, 494 to 493. Political newcomer Orville Knox led the race for Red Bluff City Council with 573 votes. Three spots are available and incumbents Daniele Jack- son (560 votes) and Rob Schmid (516) held the next two positions. Former Councilman Larry Stevens trailed with 440 votes. In Corning appointed incum- bent Dave Linnet (281) and in- cumbent Darlene Dickison (238) led John Leach (176) for the two seats on the City Council. Incumbent Elsa Marie Marti- nez, with 1,038 votes, was dead last amongst seven candidates for three spots on the Red Bluff Joint Union High School District Governing Board. James Keefer led with 2,110 votes, followed by Rodney Thompson (2,007), Christ Hur- ton (1,558), Joy Nelson (1,242, Frank Perino Jr. (1,141), Joe Hutchens (1,093) and then Mar- tinez. The Red Bluff Union School District Governing Board had two separate races. Three four-year terms were up for election with Sharon Barrett (1,105) leading Steven Piffero (956), Adriana Griffin (878) and Morgan Nuckols (454). Tehama County Superior Court Judge John Garaventa issued his ruling in writing Monday. "The Defendant has carried his burden of proving there is a rea- sonable likelihood that a fair and impartial trial of this case may not be had in Tehama County," Garaventa wrote in his conclu- sion. Garaventa wrote that a trial court must take into account five factors when considering a change of venue motion: the na- tu re a nd g ra vi ty o f th e off e ns e, the size and characteristics of the community, the status of the defendant in the community, the popularity and prominence of the victim in the community and the nature and extent of the publicity in the community. Garaventa concluded the most compelling factors leading to a change of venue in this case were the extensive publicity of the case, the county's size and characteris- tics and the status of the defen- dant. The victim's status and na- ture and gravity of the crime he found to be significant, but less important. "Each factor alone might not be determinative, however an ex- amination of all five factors to- gether weigh in the defendant's favor for a change of venue," Ga- raventa wrote. The Tehama Superior Court will notify the Administrative Di- rector of the Courts, which will then advertise to find an available court that would be burdened by the case transfer. Garaventa scheduled a confer- ence for 9 a.m. Nov. 10. Bealer is charged with kill- ing Nichols in February 2013. She was last seen near Red Bluff Union High School and her body was discovered two days later in a wooded area just south of the campus.
