CALL TODAY 527-2151 PublishedNovember1,2014 LEGAL NOTICE ORDINANCENO.1995 AN ORDINANCE OF THE TEHAMA COUNTY BOARD OF SUPERVISORS APPROVING REZONE #14-04 AND AMENDING THE ZONING MAP OF THE COUNTY OF TEHAMA THE BOARD OF SUPERVISORS OF THE COUNTY OF TEHAMA ORDAINS AS FOLLOWS: SECTION 1: The Zoning Map of the County of Tehama, as set forth in Section 17.06.020 of the Tehama County Code and its subsections, is hereby amended by the addition of a new subsection 17.06.020.14-04, being Amended Zoning Map No. 14-04. SECTION 2: Amended Zoning Map No. 14-04 is attached hereto and incorporated herein. The brief description of the property, as recited in the notice of hearing, is as follows: The site is located on the eastside of I-5 and is directly north of Manor Lane. Specifically, a 230 foot by 650 foot area in the southeast portion of Lot 45 of the Orchard Park Subdivision recorded at Book F of Maps, Page 1, of the Official Records of Tehama County, California as found at 22030 Manor Lane, Red Bluff. SECTION 3: As conditions this rezoning, any construction or development upon property subject to this Ordinance shall comply with the following: Condition #1 COMPLIANCE WITH AGENCY REQUIREMENTS. Applicant shall meet the requirements of all Federal, State and local agencies. Condition #2 COMPLIANCE WITH BUILDING DEPARTMENT. Applicant shall meet all of the requirements and regulations of Building Department. Condition #3 COMPLIANCE WITH ENVIRONMENTAL HEALTH. Applicant shall meet all of the requirements and regulations of Environmental Health. Condition #4 COMPLIANCE WITH CAL FIRE. Applicant shall meet all of the requirements and regulations of Tehama County CAL FIRE. Condition #5 INDEMNIFICATION. The Applicant shall further pay all losses, liabilities, damages, penalties, costs, awards, judgments, fees (including reasonable attorneyís fees) and expenses arising from such claim, action, or judicial or administrative proceeding. Counsel for the County Indemnitees in any such legal defense shall be selected by the County. Upon request of the County, the Applicant shall execute a formal written agreement containing the foregoing terms, but the Applicant's obligations hereunder shall be fully operative and enforceable regardless of whether such an agreement is executed. Condition #6 CEQA FEES. Within five working days after project approval, the applicant shall pay a mandatory Notice of Exemption filing fee of $50.00 (or latest fee in effect at time of payment) for the Tehama County Clerk processing. Condition #7 LOT LINE ADJUSTMENTS. Any proposed Lot Line Adjustments/Mergers must comply with Tehama County regulations and the Subdivision Maps Act requirements. Condition #8 EXISTING USE PERMITS 02-17 AND 10-08. UP #02-17 and UP #10-08 remain in force and in effect and the applicant/developer/property owner must comply with ALL conditions of approval as conditioned for each respective use permit. SECTION 4: This Ordinance shall take effect thirty (30) days from and after its adoption, and prior to the expiration of fifteen (15) days from the adoption thereof shall be published for at least one time in the Red Bluff Daily News, a newspaper of general circulation in Tehama County.
