Wednesday, August 31, 2011 – Daily News 3B COURT ROUND-UP Recent State Prison Commit- ments • Richard Arnold Stephens was sentenced to three years and four months in state prison for cultivating marijuana, special allegation-prior strike; aid by misrepresentation, forgery. Agents conducted a probation search of Stephens' residence and located several marijuana plants. Stephens was originally granted for- mal probation. Stephens violated his probation when he was found in pos- session of marijuana plants as stated in case number NCR81889. • Christopher Lee Wilson was sen- tenced to two years in state prison for possession of a controlled substance, possession of a controlled substance. An officer contacted defendant after observing him riding a bicycle at night without a light. After obtaining consent to search, the officer located marijuana and methamphetamine inside a bag attached to the bicycle. Wilson was originally granted formal probation. He violated his probation when he arrested in case number NCR82094. • Marcelino Ortiz Godinez was sentenced to 16 months in state prison for possession for sale of a controlled substance. An officer conducted a traffic stop on a vehicle driven by Godinez. After confirming Godinez did not possess a valid driver's license the officer deployed his K-9 who alerted on the vehicle. Inside the vehicle the officer located a digital scale and baggies of methamphetamine. • Emiliano Barajas was sentenced to 16 months in state prison for pos- session of firearm by felon. Officers conducted a search war- rant at Barajas' residence and located several guns and ammunition. Recent County Jail Commit- ments • Alfonso Fregoso Jr., was sen- tenced to 270 days in Tehama County Jail for possession for sale of a con- trolled substance. An officer conducted a traffic stop on a vehicle driven by Fregoso. The officer deployed his K-9 who alerted on the vehicle. The officer then con- ducted a search and located metham- phetamine inside a false compartment in the vehicle. Recent Proposition 36 Commit- ments Note: All cases wherein a defen- dant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attor- ney's Office. Per the requirements of Proposition 36, a defendant who pos- sesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defen- dant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attor- ney's Office contends that each crimi- nal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sen- tence should properly be imposed. • Harley Joe Adkins was sentenced to Prop. 36 probation for transporta- tion of a controlled substance. An officer conducted a traffic stop on a vehicle driven by Adkins. The officer was advised Adkins was on searchable parole and conducted a search. Inside the vehicle the officer located heroin. • Charles Dale Maxfield Jr., was sentenced to Prop. 36 probation for possession of a controlled substance. A deputy made contact with Max- field and a passenger who were BATAVIA, N.Y. (AP) — A Massachusetts man whose colorful golf attire was briefly mistaken for a clown outfit has been charged in New York with driving a golf cart while drunk. The Genesee County sheriff says they got a report that someone dressed as a clown was operating a stolen golf cart in the west- ern New York town of Batavia on Sunday night. Deputies found 37-year-old James Straub, of Stoneham, Mass., driving along a road. He wasn't dressed as a clown — just wearing some colorful clothing after an outing at Terry Hills Golf Course. But deputies say he parked along side the road. After observing the passenger making furtive movements inside the vehicle the deputy conducted a search of the vehicle and located methampheta- mine, marijuana and a syringe. Upcoming Court Dates -Trials, Preliminary Hearings(PX) & Pre Trial Conferences(PTC): • Earl Ray Hughes will appear in court for a pre-trial conference at 1:15 p.m. on Sept. 12 in Department 2. He is facing the charges of vehicular manslaughter without gross negli- gence, DUI causing injury with spe- cial allegation- bodily injury to more than one victim, special allegation- great bodily injury, driving with a 0.08 percent blood alcohol causing injury with special allegation-bodily injury to more than one victim, spe- cial allegation-great bodily injury, possession of an assault weapon, unli- censed driver. Officers responded to the scene of a single vehicle accident. Upon inves- tigating the incident officers deter- mined Hughes had been driving while intoxicated when he lost control of his vehicle and hit a tree. There were two passengers in the vehicle at the time. • Chrissy Ann Dunn will appear in court for further sentencing at 8 a.m. on Sept. 13 in Department 3. She is facing the charges of lewd act upon a child, oral copulation of a person under 16. Officers received a report that Dunn was having sexual relations with a minor. An investigation into the incident was conducted in which officers determined that on numerous occasions Dunn had sexual encoun- ters with the 14 year old victim. • Jeffrey S. Vanderveer will appear in court for a preliminary hearing at 8 a.m. on Sept. 13 in Department 3. He is facing the charges of possession of matter depicting minor engaging in sexual conduct. Vanderveer was being investigated for filming girls at a local gym by mounting a camera under a desk. Dur- ing the investigation the Vanderveer's computer was seized and investigators located several items of child pornog- raphy. • Jakob Skott Peterson will appear in court for a pre-trial conference at 1:15 p.m. on Sept. 19 in Department 2. He is facing the charges of 10 counts of lewd act upon a child, 10 counts of unlawful sexual intercourse and child stealing. Peterson was having sexual rela- tions with the 13-year-old victim. Peterson picked up the victim from her home and refused to advise any- one of her whereabouts until he was arrested several days later. • Victor Hugo Rodriguez will appear in court for a preliminary hear- ing at 3 p.m. on Sept. 21 in Depart- ment 3. He is facing the charges of murder, gross vehicular manslaughter while intoxicated, special allegation- fleeing the scene of the crime, leaving the scene of an accident. Officer responded to the scene of a hit and run. Upon arrival officers were advised by several witnesses that Rodriguez had taken off in his vehicle and hit a parked car. Rodriguez con- tinued driving across town and failed to stop for the victim who was walk- ing her bike in a crosswalk. Rodriguez hit the victim with his vehicle and again fled the scene. The victim was taken to the hospital where she died hours later. • Thomas Charles Scott will appear in court for a preliminary hearing at 8 a.m. on Oct. 12 in Department 3. He is facing the charges of cultivating marijuana with special allegation- prior strikes, possession of marijuana for sale with special allegation-prior strikes, possession of concentrated cannabis with special allegation-prior strikes, maintaining place for selling or using controlled substance with special allegation-prior strikes. Agents from the drug task force served a search warrant at Scott's res- idence and located large amounts of marijuana, concentrated cannabis and marijuana food products for sale. (AP) — A central Pennsylvania man has been charged for a second time with trying to steal a rack of ribs by shov- ing them down his pants. Carlisle police tell The Sentinel newspaper (http://bit.ly/rhCtxV) that 65-year-old Donald Noone tried to hide about $20 worth of ribs in his pants on Sunday. Police say he attempted to pull the same stunt on May 22 at a supermarket and pleaded guilty to retail theft and public drunken- ness. Police say that since this is a second offense, the theft charge will be consid- ered a more serious sec- ond-degree misdemeanor. There was not a listed telephone number for Don- ald Noone in Carlisle.
