TCSO – People vs. John Manuel Cabral, (NCR81286); PC245(a)(1)- Assault With a Deadly Weapon, Special Allegation PC1170.12(a)-(d)-Prior Strike. Officers responded to defendant’s res- idence in regards to a domestic distur- bance. Upon investigating the incident officers were advised defendant had punched the victim in the face and threatened to cut her throat if she called the police. Defendant fled the residence before officers arrived but was later located and taken into custody. Sentenced to 4 years State Prison. 2. RBPD – People vs. Matthew Charles Lane, (NCR79181)VOP; PC273.5(a)-Corporal Injury to Spouse/Cohabitant. Brief history:Defendant was original- ly granted formal probation. Defendant violated his probation when he failed to keep in contact with probation and keep them informed of his current contact information. Sentenced to 3 years State Prison. 3. TCSO - People vs. Albert Vernon Nichols, (NCR80740) VOP; HS11379(a)-Transportation of a Con- trolled Substance. Brief history: Defendant was original- ly granted formal probation. Defendant violated his probation when he failed to keep in contact with probation and failed to complete his drug treatment program. Sentenced to 3 years State Prison. 4. CPD – People vs. Michael Ray Yates, (NCR81726); PC12021(a)(1)-Pos- session of a Firearm by a Felon, Special Allegation PC1170.12(a)-(d)-Prior Strike. Brief history: Officers responded to a location regarding defendant pointing a gun at the victim. Upon arrival officer placed defendant under arrest for an out- standing warrant. During a consent search of defendant’s vehicle officers located two handguns and ammunition. Sentenced to 32 months State Prison. 5. TCDA – People vs. James Thomas Smith, (NCR80621); PC1320(b)-Failure to Appear on Own Recognizance, Spe- cial Allegation PC1170.12(a)-(d)-Prior Strike. Brief history:Defendant failed to appear in court as ordered. Sentenced to 32 months State Prison. 6. RBPD - People vs. David Earl Clopp, (NCR79158)VOP; PC459-Second Degree Commercial Burglary. Brief history:Defendant was original- ly granted formal probation. Defendant violated his probation when he was con- tacted by a probation officer and refused to submit to a search. Defendant was later found in possession of a substance used to adulterate urine tests. Sentenced to 2 years State Prison. 7. TIDE – People vs. Juan Carlos Cabrera, (NCR81680); HS11378-Posses- sion For Sale of a Controlled Substance. Brief history:An officer conducted a traffic stop on a vehicle occupied by the defendant and a companion. A consent search of the vehicle revealed a hidden compartment containing metham- phetamine. Sentenced to 2 years State Prison. 8. CDC - People vs. Daniel Torres, (NCR81285); PC4573.6-Possession of a Controlled Substance in a Jail. Brief history: Defendant was incar- cerated in a California Department of Corrections Conservation Camp when officers located a marijuana pipe inside defendant’s locker. Sentenced to 2 years State Prison. 9. USDA – People vs. Rosendo Val- divias Soto, (NCR81900), PC182(a)(1)- Conspiracy to Commit a Crime. Brief history: Agents from the forest service contacted the defendant and sev- eral other males as they were walking out of the brush towards a vehi- cle that had just pulled off the roadway. After receiving consent to search the vehicle agents located several hundreds of pounds of food, supplies, a handgun and marijuana seeds. Sentenced to 16 months State Prison. Recent County Jail Commitments: 10. F&G – People vs. Sergio Soto Magana, (NCR81799); HS11359-Posses- sion of Marijuana For Sale. Brief history:Defendant was a passen- ger in a vehicle that was stopped for a traffic violation. Upon contacting the occupants of the vehicle the officer could smell the odor of marijuana coming from the vehicle. A search of the vehicle revealed a large amount of marijuana seedlings and cultivation materials. Sentenced to 300 days county jail. 11. TIDE – People vs. Ruben Edgar Vargas, (NCR74514)VOP; HS11359- Possession of Marijuana For Sale. Brief history: Defendant was original- ly granted formal probation. Defendant violated his probation when he was arrested for a DUI and tested positive for marijuana. Sentenced to 90 days county jail. 12. RBPD – People vs. Lesli Marie Johnson, (NCR81822); PC211-Second Degree Robbery. Brief history: Defendant entered the lobby of a local hotel and demanded money from the desk clerk. Defendant then leaves with one dollar and was located and arrested a short time later. Sentenced to 90 days county jail. 13. RBPD - People vs. James William Mitchell, (NCR81589); PC594(a)-Van- dalism-Over $400 Damage. Brief history: Officers responded to an apartment complex in regards to sev- eral vehicles that had their windows bro- ken out. After speaking with witnesses regarding this incident officers contacted defendant at his residence and located an aluminum bat with small pieces of glass still stuck in the aluminum. Sentenced to 60 days county jail. 14. RBPD - People vs. Brett Ronnie Thomas Howell, (NCR81460); HS11350(a)-Possession of a Controlled Substance. Brief history: An officer conducted a traffic stop on a vehicle driven by the defendant. The officer was advised defendant had an outstanding warrant and placed him under arrest. During a pat down search the officer located a metal tube used for smoking controlled substances as well as several prescription pills found inside defendant’s vehicle. Sentenced to 60 days county jail. Recent Proposition 36 Commit- ments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney’s Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attor- ney’s Office contends that each criminal case is unique and that in certain, specif- ic, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. 15. Brief history: Agents conducted a parole search on defendant and located methamphetamine and a methampheta- mine smoking pipe. probation. Defendant sentenced to Prop. 36 16. TCSO - People vs. Amanda Marie Shoffner, (NCR81491); HS11377(a)- Possession of a Controlled Substance. Brief history: Deputies contacted defendant in regards to an unrelated inci- dent. After receiving consent to search defendant’s room officers located methamphetamine, a hypodermic syringe and marijuana. Defendant sentenced to Prop. 36 pro- bation. Brief history: Officers responded to the scene of a single vehicle accident. Upon investigating the incident officers determined defendant had been driving while intoxicated when he lost control of his vehicle and hit a tree. There were two passengers in the vehicle at the time. One of the passengers received serious injuries while the other passenger was pronounced dead at the scene. Brief history:Defendant was having sexual relations with the 13 year old vic- tim. Brief history:Defendant was original- ly granted formal probation. Defendant violated his probation when he failed to complete several court ordered programs. Brief history: Defendant was being investigated for filming girls at a local gym by mounting a camera under a desk. During the investigation the Defendant’s computer was seized and investigators located several items of child pornogra- phy. PX Date: August 16, 2011 at 8:00 a.m. in Department 3. 22. TCSO - People vs. William Holt Baymiller (NCR74998) PC187(a), 2nd Degree Murder Brief history: The Tehama County Sheriff’s Office received a 911 call from a man who said that defendant showed up at his house and claimed he just shot and killed his dad. Defendant showed the man his California Driver’s License. Deputies arrived and located the defen- dant at his father’s home armed with a shotgun. The Sheriff’s office took defen- dant into custody after a brief stand-off. Upon entering the residence, TCSO located the victim with a fatal gunshot wound to the chest. Defendant claimed that he was going to be killed by "Mus- lims" and he "believed" that his dad was in on it. Brief history: Officer responded to the scene of a hit and run. Upon arrival officers were advised by several witness- es that defendant had taken off in his vehicle and hit a parked car. Defendant continued driving across town and failed to stop for the victim who was walking her bike in a crosswalk. Defendant hit the victim with his vehicle and again fled the scene. The victim was taken to the hos- pital where she died hours later. PX Date: August 18, 2011 at 9:00 in Department 1. 24. CPD – People vs. Chrissy Ann Dunn, (NCR81550); PC288(c)(1)-Lewd Act Upon a Child, PC288(a)(b)(2)-Oral Copulation of a Person Under 16. Brief history: Officers received a report that defendant was having sexual relations with a minor. An investigation into the incident was conducted in which officers determined that on numerous occasions the defendant had sexual encounters with the 14 year old victim. Brief history: Agents served a search warrant at the defendant’s warehouse off of Baker Road in Red Bluff. Inside they found over 400 marijuana plants. DABI – People vs. Gann Bradford Gannon, (NCR78866); PC487(a)-Grand Theft of Personal Property(20 counts). Brief history: Defendant owned a local car lot and sold cars to various people. During many of the sales defendant failed to pay the DMV fees. Defendant also sold extended warranties on the vehicles but instead of paying the war- ranty company defendant kept the money leaving many vehicle owners without their warranties.
