Dated: August 5, 2014 BEVERLY ROSS, County Clerk County of Tehama State of California Publish: August 8, 2014 LEGAL NOTICE ORDINANCE NO. 1992 AN URGENCY ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUNTY OF TEHAMA AMENDING CHAPTER 9.40 OF THE TEHAMA COUNTY CODE TO ESTABLISH A STREAMLINED PROCESS FOR IS- SUANCE OF TEMPORARY EMER- GENCY PERMITS FOR OFF- PARCEL GROUNDWATER USE THE BOARD OF SUPERVISORS OF THE COUNTY OF TEHAMA OR- DAINS AS FOLLOWS: SECTION 1. The Board of Supervisors of the County of Tehama, by four-fifths vote, hereby finds and declares the following: (A) The County of Tehama is experiencing record dry conditions, with 2014 pro- jected to become the driest year on record. (B) California's wa- ter supplies statewide, including those serving Tehama County, have dipped to alarming levels, indicated by: snowpack in Cali- fornia's mountains is approxi- mately 20 percent of the normal average for this date; Califor- nia's largest water reservoirs have very low water levels for this time of year; California's major river systems, including the Sacramento and San Joaquin rivers, have significantly re- duced surface water flows; and groundwater levels throughout the state have dropped signifi- cantly. (C) While dry condi- tions have persisted statewide since 2012, the magnitude and severity of the drought this year was sudden and unexpected. (D) On January 17, 2014, the Governor of the State of California proclaimed a state of emergency due to current drought conditions pursuant to section 8625 of the California Government Code. This state of emergency presently remains in effect. (E) Many Tehama County residents are dependent upon dwindling surface water and groundwater supplies as their primary source of potable water. In certain areas of the County these sources are se- verely threatened by the current drought conditions, leaving these residents without any reli- able source of water for basic domestic needs. (F) The threat to drinking water supplies in many areas is clear and imminent, re- quiring immediate action to mit- igate the hazards to the health, welfare, and property facing the affected Tehama County resi- dents. (G) The establish- ment of a streamlined process to permit the extraction of groundwater for off-parcel use as an alternative source of pota- ble water for properties whose current water supplies are threatened by the drought is a specific action that the County of Tehama can take to mitigate this emergency. (H) Such stream- lined process shall be utilized only under conditions of emer- gency as defined in applicable law, and shall not be used where the extraction of groundwater would result in overdraft or the mining of water. (I) Adoption of the amendments made by this Ordi- nance without delay is necessa- ry for the immediate preserva- tion of the public peace, health, and safety, as set forth in Gov- ernment Code section 25123, subdivision (d), in order to ena- ble affected County residents to have access to uninterrupted supplies of potable water for ba- sic domestic needs. SECTION 2. Section 9.40.075 is hereby added to the Tehama County Code to read: 9.40.075TemporaryEmer- gency Permits. A. Notwithstanding any other provision of this Chapter, the Board of Supervisors may grant a temporary emergency permit in accordance with this section without undertaking the procedures set forth in Sections 9.40.050 through 9.40.070, and without a public hearing. B. A temporary emergency permit may be is- sued if the Board finds that the proposed use of water on other than the parcel of land upon which the extraction occurs is necessary to prevent or mitigate an emergency, as defined in Public Resources Code section 21060.3. Replacement of domes- tic water supplies rendered un- available due to drought condi- tions for which a state of emer- gency has been proclaimed by the Governor shall constitute mitigation of an emergency un- der this section. C. A temporary emergency permit shall be is- sued only if the Board finds that such approval is exempt from review under the California Envi- ronmental Quality Act pursuant to Public Resources Code sec- tions 21080, subdivision (b), 21172, or California Code of Reg- ulations, title 2, section 15269 or successor provisions. D. A temporary emergency permit may only be granted if the Board finds and determines that the permit will not bring about an overdraft and will not result in the mining of water. E. The Board shall impose such conditions upon the temporary emergency per- mit to prohibit overdraft, and may impose conditions includ- ing, but not limited to, identifi- cation of the well or water source to be used for water ac- quisition, the timing and quanti- ty of water to be transferred at any time, and a requirement for county observation and/or mon- itoring of the well identified for use, that it deems necessary for the health, safety, and welfare of the people of the County of Tehama. F. A temporary emergency permit issued under this section shall be effective for the limited term specified by the Board, not to exceed 180 days. Board, days. G. The decision of the board of supervisors shall be final. SECTION 3.This Ordinance is an urgency ordinance necessary for the immediate preservation of the public peace, health, and safety. Pursuant to Government Code section 25123, subdivision (d), this ordinance shall take ef- fect immediately upon adoption by four-fifths of the Board of Su- pervisors, and prior to the expi- ration of fifteen (15) days from the adoption thereof shall be published at least one time in the Red Bluff Daily News, a newspaper of general circula- tion in Tehama County. Project Description: The Project intends to replace and expand the existing CAL FIRE VinaHelitack Base complex al- lowing the base to continue to provide high quality fire protec- tion and emergency response service within the State Respon- sibility Area (SRA) and that would accommodate the chang- ing aviation and event-response parameters of the facility. The Project would include the demolition and new construc- tion of several elements. The im- provements would include the following: • 22-bed barracks building • three-bay apparatus building • generator/pump/storage building • five-blade helicopter hangar (to occur at a later date but in- cluded as a part of this environ- mental analysis) • reconstructed primary helipad and a new secondary helipad • relocated helicopter fueling in- frastructure • training tower apparatus • construction of a new south- bound deceleration and acceler- ation lane, reconstruction of the northbound lane configuration to accommodate the new lane on SR 99, new driveway ap- proach apron, and new roadway drainage infrastructure Potentially Significant Environ- mental Impacts: Potentially sig- nificant impacts toair quality, bi- ological resources, cultural re- sources, and hazards and haz- ardous materialswere identified in the Initial Study.
