If the appeals courts con- tinue the unbroken eight- month streak of rulings in favor of gay marriage, that could make it easier for the nation's highest court to come down on the side of supporters. If even one ruling goes against them in the four courts taking up the issue in the coming weeks, it would create a divide that the Su- preme Court also could find difficult to resist settling. "We're going to be racking up more courts of appeals decisions, and every one we get puts more pressure on the Supreme Court to weigh in," said Douglas NeJaime, a law professor at the Uni- versity of California-Irvine. "It's very likely the Supreme Court ultimately settles this question. Given how quickly things have moved, it's hard for the court to avoid this in the short term." A three-judge panel of the 6th U.S. Circuit Court of Ap- peals in Cincinnati will hear arguments from attorneys in six cases from Kentucky, Michigan, Ohio and Tennes- see, all Wednesday, the most of any federal appeals court so far. Similar arguments are set for Aug. 26 in the 7th Circuit in Chicago, for bans in Wis- consin and Indiana, and for Sept. 8 in the 9th Circuit in San Francisco, for bans in Idaho and Nevada. The 5th Circuit in New Orleans is ex- pected to soon set a date to hear arguments on Texas' ban. The flurry of arguments means an upcoming spate of rulings, possibly all is- sued this autumn, that could profoundly alter the nation's marriage laws. If the four federal circuit appeals courts rule in favor of gay marriage, then nine states with pending appeals stand to have their bans stricken down altogether or ordered to recognize out-of- state gay marriages: Ohio, Michigan, Tennessee, Ken- tucky, Texas, Indiana, Wis- consin, Idaho and Nevada, though the decisions likely would be put on hold for a Supreme Court ruling. Five additional states un- der those four circuit courts have gay marriage lawsuits awaiting decisions by federal judges:Alaska,Arizona,Lou- isiana, Mississippi and Mon- tana. Observers say the 6th or 5th circuits could deliver the first victory for gay marriage opponents. Thethreejudgesatthe6th Circuit set to hear gay mar- riage arguments Wednes- day are Jeffrey S. Sutton and Judge Deborah L. Cook, both George W. Bush nom- inees, and Martha Craig Daughtrey, a Clinton nomi- nee. Among them, Sutton is considered to be the least predictable. In 2011, he shocked Re- publicans when he became the deciding vote in a 6th Circuit ruling that upheld the Obama administration's health care overhaul. "This is the kind of thing where you could see the con- servative with a libertarian bent coming out in favor of gay marriage, but who knows?" said Mark Tushnet, a constitutional law profes- sor at Harvard. Pat Roberts on Tuesday seized an early lead over tea party favorite Milton Wolf in Kansas' pri- mary as four states kicked off a busy month of contests to settle the ballots for No- vember's midterm elections. Roberts held a 52 percent to 37 percent edge over Wolf, a radiologist and distant cousin of President Barack Obama, with just a handful of precincts reporting. Four Kansas counties ended vot- ing later in the night. The Kansas race pitted a mainstream Republican against an upstart who ar- gued that the incumbent wasn't true to core conser- vative beliefs. It was one of the last, best chances for the tea party. The GOP establishment blames the tea party for costing it Senate control in 2010 and 2012 as outside candidates stumbled in the general election. Republi- cans need to gain six seats to regain the Senate, and the party has taken no chances this election cycle, putting its full force behind incum- bents and mainstream can- didates. Tuesday offered competi- tive primaries in Michigan, Missouri and Washington state. Businessman Dave Trott grabbed an early lead — 65 percent to 35 percent — over first-term Rep. Kerry Bentivolio in Michigan's 11th Congressional District, a re- versal of the recent political order of tea partyers aim- ing to knock out an estab- lishment favorite.
