Thefollowingdefendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney's Office: RecentState/Local Prison Commitments: People vs. Jesse Allen Janto, Possession For Sale of a Controlled Substance with Special Allegation Prior Strike, Special Alle- gation Personally Armed/ Firearm Controlled Sub- stance. Brief history: Deputies served a search warrant at defendant's residence and located several firearms, methamphetamine and marijuana. Sentenced to 10 years State Prison. People vs. Nicholas Kurt Hardwick, First Degree Residential Burglary with Special Allegation Prior Strike. Brief history: Victim re- turned home and found a vehicle parked in her drive- way and the shower run- ning in her residence. The victim left the scene and contacted law enforcement. When deputies arrived the defendant had already fled the area. Defendant was later located and arrested after being involved in a vehicle pursuit. The defen- dant was found in posses- sion of laptops that were stolen from victim's resi- dence. Sentenced to 8 years State Prison. People vs. Joe Landecho Lopez, Transportation of a Controlled Substance; Transportation of a Con- trolled Substance, Trans- portation of a Controlled Substance; Non-Sufficient Funds; Possession For Sale of a Controlled Substance, Maintaining Place For Sell- ing or Using Controlled Substance. Brief history: Defendant was originally granted for- mal probation on all cases. Defendant violated his pro- bation when he failed to keep in contact with pro- bation, failed to appear for his revocation hearing, was found in possession of a billy club and maintained a residence for the use and sales of methamphetamine. Officers served a search warrant at defendant's resi- dence and located metham- phetamine, smoking pipes, syringes, digital scales and a billy club. Sentenced to 7 years 8 months State Prison. People vs. Julie Angela Barnes, Possession For Sale of a Controlled Substance, Maintaining Place for Sell- ing or Using Controlled Substance. Brief history: Defendant was originally granted formal probation. Defen- dant violated her proba- tion when she was found in possession of methamphet- amine and admitted to sell- ing methamphetamine. Sentenced to 3 years 8 months State Prison. People vs. Robert Joseph Cassidy, Escape Brief history: Defendant was out of custody on an an- kle monitor when he failed to keep the ankle monitor charged as required and re- moved it without authoriza- tion. Sentenced to 2 years State Prison. People vs. Emerson James Yates, Possession of a Controlled Substance. Brief history: Defendant was originally granted for- mal probation. Defendant violated his probation when he was found to have falsi- fied signatures on atten- dance cards for drug and alcohol treatment program meetings that he did not at- tend. Sentenced to 2 years Lo- cal Prison. People vs. Daniel Elliot Baker, Possession of Matter Depicting Minor Engaging in Sexual Conduct. Brief history: Defendant was found in possession of child pornography. Sentenced to 16 months State Prison. People vs. Craig John Crow, Vandalism Brief history: Defendant was observed picking up a trash can and throwing it into the side of a vehicle. Sentenced to 16 months Local Prison. People vs. Brian Neil Ko- rodi, Failure to Appear on Own Recognizance. Brief history: Defendant was originally granted for- mal probation. Defendant violated his probation when he tested positive for mar- ijuana and methamphet- amine. Sentenced to 16 months Local Prison. People vs. Anthony Mon- tana Deuel, Damaging Prison or Jail. Brief history: Defen- dant was in custody at the jail when he became an- gry and began yelling and kicking his cell door caus- ing damage. Sentenced to 16 months State Prison. Recent County Jail Commitments: People vs. Ashley Eliza- beth Lakey, Second Degree Commercial Burglary; Fail- ure to Appear on Own Re- cognizance. Brief history: Defendant was originally granted for- mal probation on both cases. Defendant violated her probation when she failed to appear at proba- tion and tested positive for methamphetamine. Sentenced to 240 days county jail. People vs. Scott Michael Zacharias, Second Degree Commercial Burglary; Fail- ure to Appear on Own Re- cognizance. Brief history: Defendant had stolen items from the victim and attempted to pawn them at a local pawn shop. Defendant was re- leased from custody on his own recognizance and failed to appear in court as ordered. Sentenced to 210 days county jail. People vs. Hunter Ed- ward Harris, Evading an Officer, Willful Disregard, Unlawful Driving or Tak- ing of a Vehicle; Receiving Stolen Property-Motor Ve- hicle, Driving Under the Influence of Alcohol and/ or Drugs. Brief history: Officers lo- cated a vehicle matching the description of one that had recently been reported sto- len. The officers attempted to conduct a traffic stop on the vehicle. The defendant failed to yield and a pur- suit ensued. Officers even- tually apprehended defen- dant after he ran the vehicle through a fence and came to a stop. Defendant was originally granted formal probation. Defendant vio- lated his probation when he failed to contact probation and keep them informed of his current contact infor- mation. Sentenced to 210 days county jail. People vs. Edgardo Ga- vidia Benites, Maintaining Place For Selling or Using Controlled Substance. Brief history: An officer conducted a traffic stop on a vehicle driven by defendant. Upon contacting the defen- dant the officer received consent to search the vehi- cle. Inside the trunk the of- ficer located methamphet- amine. Sentenced to 180 days county jail. People vs. Christina Nicoll, Post Release Com- munity Supervision. Brief history: Defendant was released from prison to post release community supervision. Defendant vi- olated the terms of her su- pervision when she tested positive for methamphet- amine and failed to appear at probation as directed. Sentenced to 180 days county jail. People vs. Daisy Wright, Possession of a Controlled Substance. Brief history: Defendant was originally granted for- mal probation. Defendant violated her probation when she failed to keep in contact with probation. Sentenced to 120 days county jail. People vs. Jason William Colston, Transportation of a Controlled Substance. Brief history: Deputies contacted defendant and found him in possession of methamphetamine and methamphetamine pipes. Sentenced to 120 days county jail. People vs. Jacqueline La- vette Thomas, Possession of a Controlled Substance. Brief history: Defendant was originally granted for- mal probation. Defendant violated her probation when she failed to keep in contact with probation and failed to appear in court as ordered. Sentenced to 120 days county jail. People vs. Randy Burril Dunham, Failure to Update Annual Registration. Brief history: Defendant is a convicted sex offender and failed to register annu- ally as required. Sentenced to 90 days county jail. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County Dis- trict Attorney's Office. Per the requirements of Propo- sition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. In- stead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related proba- tion violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County Dis- trict Attorney's Office con- tends that each criminal case is unique and that in certain, specific, cases a defendant should be sen- tenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non- compliance with either pre- vious grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. People vs. Waylon Zacha- riah Walters, Possession of a Controlled Substance. Brief history: A deputy contacted defendant and found him in possession of Norco pills. Defendant sentenced to Prop. 36 probation. People vs. Megan Louise McCoy, Possession of a Con- trolled Substance. Brief history: Deputies re- sponded to a report of a sus- picious vehicle. Upon arrival deputies located the unoc- cupied vehicle parked in the driveway of a residence. Deputies contacted defen- dant inside the residence and found her in possession of methamphetamine. Defendant sentenced to Prop. 36 probation. People vs. Patricia De- nise Harmon, Possession of a Controlled Substance. Brief history: An officer contacted defendant and found her in possession of methamphetamine. Defendant sentenced to Prop. 36 probation. Upcoming Court Dates -Trials, Preliminary Hearings (PX) & Pre Trial Conferences (PTC): People vs. Poly Duenas Sanchez/Lucio Nenecia Madera/Gabino Madera- Murder with Special Alle- gation Personal and Inten- tional Discharge of a Fire- arm, Conspiracy to Commit a Crime with Special Alle- gation Personal and Inten- tional Discharge of a Fire- arm, GBI. Brief history: Victim had met up with the three de- fendants regarding money that was allegedly owed to the victim. During this confrontation the victim was chased down and shot twice with a shotgun. The victim died as a result of his injuries. EOP/Setting: July 29 at 8 a.m. in Department 3. (San- chez) Setting: Aug. 19 at 8 a.m. in Department 3. (L. Madera/G. Madera) People vs. Jessie Lee Ro- bison, Murder with Special Allegations-Use of Deadly Weapon, Prior Felony, Prior Strike, Prior Serious Felony. Brief history: Defen- dant and victim had been fighting when the defen- dant pulled out a knife and stabbed the victim. The vic- tim later died as a result of his injuries. Entry of Plea/Setting: July 29 at 8 a.m. in Depart- ment 3. People vs. Tyler Allen Burrone, Vehicular Man- slaughter, Involuntary Manslaughter. Brief history: Defen- dant was driving his ve- hicle down the highway and failed to notice that the victim's vehicle had stopped in front of him and was attempting to make a left turn. Defendant rear ended the victim's vehicle and forced it into the path of an oncoming semi truck. The five year old victim in- side the vehicle received fa- tal injuries as a result of the crash and the child's mother was seriously injured. Setting: Aug. 6 at 9 a.m. in Department 4 People vs. Roger Sandy Bounnhaseng, Alan Duane Doulphus Jr., Chase Alan Doulphus: Murder, special allegation felony murder, personal and intentional, use of a firearm, assault with a firearm, false impris- onment by violence, trans- portation of marijuana. Brief history: The defen- dants went to a residence that contained a marijuana grow. The defendants con- fronted the victim and two other men who were at the residence and ordered them to the ground at gunpoint. The defendants proceeded to tie up the victim and the two men with zip ties and duct tape. The victim was able to free himself and at- tempt to flee the residence but was shot several times by the armed defendants. The victim eventually suc- cumbed to his injuries. De- fendant's vehicle was lo- cated a short time later and a vehicle pursuit followed. Defendant's were eventu- ally apprehended and taken into custody. Inside the ve- hicle officers located a large amount of marijuana. PTC: Aug. 18 at 1:15 p.m. in Department 3. People vs. Christopher Hougland, Murder with Special Allegation Use of Deadly Weapon. Brief history: Officers responded to a residence regarding a disturbance. Upon arrival officers lo- cated the victim who ap- peared to have several stab wounds and was bleeding profusely. The victim even- tually succumbed to his in- juries and was pronounced dead at the scene. The de- fendant was arrested and taken into custody. Sentencing: Aug. 20 at 11 a.m. in Department 2. People vs. Quentin Ray Bealer, Murder. Brief history: Defendant was arrested and charged with the murder of a 14 year old victim who had been re- ported missing when she never returned home from school. Officers located the victim's body two days later. Change of Venue Hear- ing: Aug. 27 at 9 a.m. in De- partment 1. People vs. Brandon Eric- son Branscombe, Murder, Assault on a Child Causing Death. Brief history: The 8 month old victim died as a result of injuries sustained while in the custody and care of defendant. PTC: Aug. 29 at 11 a.m. in Department 2.
