4B Daily News – Friday, June 10, 2011 COURT ROUND-UP The following defendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney’s Office: —————— Recent State Prison Com- mitments: • Bradford Denny Pinheiro III was sentenced to four years in state prison for pos- session of a firearm by a felon, special allegation-two prior felonies. An officer conducted a traffic stop on a vehicle in which Pinheiro was a passen- ger. As the vehicle came to a stop Pinheiro fled out of the passenger door on foot. Pin- heiro failed to comply with the officer’s demands and continued running. While Pin- heiro was running the officer observed Pinheiro throwing objects onto the roof of a nearby building. Additional officers responded to assist and eventually located Pin- heiro and took him into cus- tody. Officers were later able to locate a .25 caliber pistol that defendant had thrown on the roof of a building. • Roman Morales Romero was sentenced to four years in state prison for transportation of a controlled substance. An officer conducted a traffic stop on a vehicle driven by Romero. Upon contacting Romero the officer was pro- vided with a false name. The officer deployed his canine to conduct a search of the vehi- cle and located methampheta- mine in a hidden compart- ment. • Robert Gonzalez was sen- tenced to three years and eight months in state prison for pos- session for sale of a con- trolled substance, evading an officer, willful disregard. An officer conducted a traffic stop on a vehicle in which Gonzalez was a passen- ger. When the officer contact- ed the occupants of the vehi- cle he became suspicious and had them exit the vehicle. When the officer attempted to deploy his canine to conduct a search Gonzalez got back into the car and sped away while the Gonzalez’ companion fled on foot. The officer pursued Gonzalez during which time the defendant was throwing narcotics out of the window. The pursuit continued until Gonzalez crashed his vehicle. Gonzalez continued to fight with the officers until he was apprehended and taken into custody. • Brook Thomas Bonner was sentenced to three years and eight months in state prison for second degree com- mercial burglary, felon in pos- session of tear gas. An officer observed the garage door of a local busi- ness to be open as well as sev- eral other doors to be broken. Upon entering the business the officer noticed several things that appeared to have been rummaged through. The officer obtained the surveil- lance video and was able to identify Bonner and eventual- ly located him after it was determined he was on parole. During a search of Bonner’s residence officers located a can of pepper spray. • Arthur Kenneth Robles was sentenced to two years in state prison for receiving stolen property, motor vehi- cle. Robles was originally granted formal probation. He violated his probation when he failed to keep in contact with probation as ordered. • Kolbie McLearn was sen- tenced to two years in state prison for second degree bur- glary of a vehicle. McLearn was originally granted formal probation. He violated his probation when he failed to keep in contact with probation as well as being terminated from the court ordered drug and alco- hol program. • Jamey Lynn Moog was sentenced to two years in state prison for theft from elder or dependent adult. Moog obtained the victim’s ATM card and made several purchases without permission from the victim. • Jacob Sky Vaughn was sentenced to 16 months in state prison for possession of marijuana for sale. Agents responded to a stor- age facility to serve a search warrant on a storage shed that was being rented by Vaughn. Upon arriving at the location the agents observed Vaughn leaving the area in a vehicle. Additional officers responded and conducted a traffic stop on Vaughn’s vehicle. Inside the vehicle the officers locat- ed marijuana while the agents searching the storage shed located additional marijuana along with marijuana plants. • Aaron Betancourt was sentenced to one year in state prison for attempt: unlawful driving or taking of a vehicle. The victim contacted police after he went to his vehicle and observed Betan- court sitting in the driver’s seat. When officers arrived on scene they contacted Betan- court inside the vehicle and observed the steering column which appeared to be disman- tled. Betancourt gave officers false names and was taken into custody. • Lorene Kay Runge was sentenced to 16 months in state prison for possession for sale of a controlled substance. Agents conducted a search of defendant’s residence and located marijuana, metham- phetamine, a digital scale and a police scanner. Recent County Jail Com- mitments: • Robert Alexander Ussery was sentenced to 120 days in Tehama County Jail for forgery. Officers responded to a location in response to a physi- cal disturbance. Upon arrival officers contacted Ussery and placed him under arrest for an outstanding warrant. While searching Ussery an officer located a roll of twenty dollar bills which were determined to be fictitious. • Shalai Adair Goss was sentenced to 90 days in Tehama County Jail for case NCR80110 and NCR81366 and 365 days county jail for case NCR77457. Charges included possession of ammu- nition-failure to appear on own recognizance, possession of a controlled substance. Case NCR81366-Officer contacted Goss and arrested her on an outstanding warrant. Inside the residence where Goss was located officers found marijuana, methamphet- amine and ammunition. (NCR80110)-Goss was arrest- ed in case number NCR77457 and was released by the Court on her own recognizance. Goss then failed to appear back in court as ordered. (NCR77457)- Goss was originally granted formal probation. She violated her probation when she failed to contact probation and failed to complete her alcohol and drug treatment program as ordered. • Brian Douglas Saul was sentenced to 60 days in Tehama County Jail for posses- sion for sale of a controlled substance. Saul was originally granted formal probation. He violated his probation when he tested positive for marijuana and methamphetamine as well as possessing ammunition while being a felon. • William Paul Mueller was sentenced to 60 days in Tehama County Jail for receiv- ing stolen property, motor vehicle. Mueller was originally granted formal probation. He violated his probation when he tested positive for alcohol. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney’s Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sen- tenced to confinement time in jail or prison. Instead, the court must place defendant on proba- tion and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation vio- lation may the court impose confinement time. In the event the defendant violates a non- drug related term of probation the court may then elect to sen- tence defendant to jail or prison. The Tehama County District Attorney’s Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defen- dant has an extensive criminal record and/or a history of non- compliance with either previ- ous grants of probation or pre- vious grants of drug treatment, a state prison sentence should properly be imposed. • Otto Chris Schulz was sentenced to Prop. 36 proba- tion for possession of a con- trolled substance. An officer conducted a traffic stop on a vehicle driven by Schulz. Upon contacting Schulz the officer located methamphetamine in Schulz’s pocket. • Tasha Nicole Foley was sentenced to Prop. 36 proba- tion for transportation of a controlled substance. An officer conducted a traffic stop on a vehicle driven by Foley. Upon contacting Foley the officer observed a large object in Foley’s pants pocket which was determined to be methamphetamine.
