COUNTY OF TEHAMA PROPOSED INITIATIVE MEASURE BALLOT TITLE AND SUMMARY Notice of Intention submitted April 29, 2014 INITIATIVE MEASURE TO REPEAL CURRENT TEHAMA COUNTY MARIJUANA CULTIVATION REGU- LATIONS If adopted by a majority of the voters, this initiative would re- peal all existing Tehama County local ordinances governing the cultivation of marijuana. The measure would further direct the Board of Supervisors to pro- pose a new'ordinance that"shall not be more restrictive on the right to cultivate than state law" and submit that ordinance to the voters at the next regularly scheduled general election. Tehama County's current ordi- nances regulating the amount of marijuana that may be cultivat- ed on any single premises, and the location, fencing, setbacks, and registration of marijuana cultivation sites would no longer be in effect, and there would be no local regulations for the culti- vation of marijuana unless and until a future ordinance is adopted in the manner provided by law. ARTHUR J. WYLENE COUNTY COUNCIL We, the undersigned qualified registered voters of Tehama County request the Board of Su- pervisors to immediately submit the following ordinance to a vote of the people at a special election. Section 1. Title. This ordinance shall be known as The Patients Right to Farm Act. Section 2. Findings and declara- tion of purpose. 1. The people of Tehama find and declare that the cultivation of cannabis within state guide- lines does not constitute a nui- sance. 2. The current ordinance causes the following harm- a. Forces landowners and their tenants to independently pay for surveys in order to comply with the restrictions (the county refuses to provide maps indicat- ing these locations) b. Reduces property values (Shasta County saw an immedi- ate reduction in property value within days of passage of the or- dinance passed in January 2014.) c. Forces landowners to sign ad- hesion contracts-holding the county harmless from any dam- ages suffered as a result of the enforcement of this ordinance d. Forces land owners to waive their 5th Amendment Rights -by signing a document that admits to violations of federal law and removes legal protections against potential asset forfei- ture; e. Government taking of proper- ty rights from landowners by Tehama County -rights that in- clude the lawful cultivation of medicinal cannabis/ in accord- ance with California laws. f. Violation of Patients rights to cultivate and possess as much cannabis as they require for their own medical purposes (People v. Kelley) l d i i f li ( p y) g. Complete deviation from Cali- fornia Zoning Authority- by ban- ning activities that are clearly permitted under State law/ in- stead of permitting them in ap- propriate zones, where similar industries operate; h. Usurps the jurisdiction of the California Agricultural Code and the Tehama County Agricultural Code-cannabis cultivation is ag- riculture. i. According to the United States Supreme Court, all medical can- nabis cultivation falls under the Interstate Commerce Clause. This ordinance prevents land- owners and their tenants from relying on agricultural allowan- ces under local land-use codes (whether for personal or com- mercial purposes); j. Violations of HIPPAA - Patients confidential information (medi- cal, financial and personal) is at risk of being made public, as a result of compliance with this Ordinance. k. Usurps State jurisdiction re- garding the legal formation of all non-profit or not-for-profit organizations, under California Corporations Code and Califor- nia Agricultural Code (i.e. the Secretary of State). I. Interferes with State Commerce/ by also usurping State jurisdiction regarding the collection of Sales Taxes (Board of Equalization) and Income Taxes (Franchise Tax Board); m. Violation of the Constitution- al Rights of Tehama County resi- dents to establish contracts and to freely associate with one an- other n. Violation of Patients rights to obtain and possess as much cannabis as they require for their own medical purposes (People v. Kelley) o. This ordinance violates Cali- fornia Health and Safety Code (qualified individuals may raise an affirmative defense to, and may establish qualified immuni- ty from, the charge of cannabis distribution anywhere in Califor- nia, including Tehama County). This defense can be raised in any criminal or civil proceed- ings p. This ordinance also creates Sanctions against qualified indi- viduals that are prohibited un- der the Compassionate Use Act. Section 3. Cannabis Defined For the purpose of this act can- nabis and marijuana are used interchangeably, Section 4. Repeal of Existing Laws. All Tehama County cannabis cultivation ordinances are here- by repealed. Section 5. Replacement of Previ- ous Laws with State Law. The County Council and Board of Supervisors are directed to pre- pare an Ordinance codifying ex- isting state law regarding set- backs, proximity to youth ori- ented facilities, plant counts, weight, and transportation of medical cannabis. The proposed ordinance shall not be more re- strictive on the right to cultivate then state law. The County Council and Board of Supervi- sors are directed to submit the proposed ordinance to the reg- istered voters of Tehama County at the next regularly scheduled general election.
