In a report to Congress, the Justice Department said such a transfer could occur without jeopardizing national security and that detainees held on suspicion of terrorism would not en- joy the same legal rights as other immigrants, includ- ing the ability to get asylum. Such detainees, the report notes, have historically been treated "as outside the reach of the immigration laws." Thereportsaidtheadmin- istration knew of no court precedent, statute or consti- tutional provision that would grantaGuantanamodetainee the right to remain perma- nently in the United States. It added that Congress would also be free to pass a law spe- cifically barring such a thing from happening. The report came in re- sponse to a provision in the annual defense policy bill seeking the Justice Depart- ment's interpretation of le- gal rights and asylum if ter- ror suspects held at the U.S. naval facility at Guantanamo Bay, Cuba, were to be trans- ferred to the U.S. The question remains mostly theoretical. President Barack Obama has pushed to close the detention facility, calling it expensive and inef- ficient, but Congress has re- peatedly barred the admin- istration from moving terror suspects to the U.S., even to maximum-security prisons. Sen. James Inhofe, R- Okla., the top Republican on the Senate Armed Services Committee, said the report's conclusion was predictable, "simply giving cover to Pres- ident Obama so that he can continue what he is already actively working towards, which is bringing terrorists onto U.S. soil." The Judiciary Commit- tee chairman, Sen. Patrick Leahy, D-Vt., said the re- port lends support for lift- ing the congressional ban on transferring detainees to the United States and should calmfearsthatitwouldharm public safety. "The executive branch must have all options available to it as it seeks to close the detention facility at Guantanamo," Leahy said. Obama received a rare victory in his effort to close the prison last December as Congress eased the most rigid restrictions on de- tainee transfers overseas. The administration had also pushed for the ability to transfer detainees to the U.S. for imprisonment, trial or medical emergencies but lost on that front. The new analysis seemed designedtoassuageconcerns that detainees would acquire new legal protections if the prisonwereshutdown.Itsaid that while relocated detain- ees would maintain the right to challenge their detention, "the government's national securityandforeignpolicyin- terestsandjudgmentsshould be accorded great weight and deference by the courts." The other looks a bit like the famously ascetic Ma- hatma Gandhi and says he relaxes by reading centu- ries-old texts. Afghanistan's presiden- tial campaign is going to a runoff between two candi- dates with little to distin- guish them on issues but sharply different personal backgrounds and styles. The first, former Foreign Minister Abdullah Abdul- lah, is a one-time aide to a famed warlord during the Afghan anti-Soviet guer- rilla campaign. The sec- ond, ex-Finance Minister Ashraf Ghani Ahmadzai, is a Columbia University-ed- ucated anthropologist who spent much of the '90s work- ing for the World Bank. Both have promised to sign a deal to allow some U.S. forces to stay in Af- ghanistan after the end of the year and have empha- sized in their campaign speeches that they will do "whatever is necessary" to advance peace — without offering specifics. With no visible differences in either candidate's position on talks with the Taliban or relations with the U.S., the run-up to the June 14 final round is likely to be dominated by horse-trading among the country's still powerful eth- nic voting blocks. After an inconclusive first round of voting in April, Afghan voters must now re- turn to the polls to select a successor to President Ha- mid Karzai, a one-time close U.S. ally who lately has been more a thorn in its side. A peaceful transfer of power would offer some hope that the hundreds of billions of dollars spent and more than 2,000 American lives lost in the war to stabilize Afghan- istan after more than three decades of conflict were not wasted. The second round will likely feature a tight race, but some observers have raised concerns that the balloting will highlight eth- nic fault lines in the country of 30 million. Abdullah, 53, has both Pashtun and Tajik parent- age. During the Soviet oc- cupation in the 1980s, he served as adviser to and spokesman for Tajik war- lord Ahmad Shah Massoud, who was assassinated by al- Qaida two days before the Sept. 11, 2001 attack. In the early days after the U.S.-led alliance toppled the Taliban regime, Abdullah became the face of Afghan- istan's anti-Taliban move- ment, giving frequent press conferences to international media. He served as foreign minister and then was the runner-up in Karzai's dis- puted re-election in 2009. Ahmadzai, a 64-year-old Pashtun, received a Ph.D. in anthropology from Colum- bia University and taught at Johns Hopkins University during the years of Soviet occupation. He then began a career at the World Bank and was finance minister in the first post-Taliban gov- ernment. He also ran in the 2009 election, coached by American campaign con- sultant James Carville, but received only 3 percent of the vote. Both candidates have named running mates cho- sen strategically from other ethnic groups, a Pashtun for Abdullah and an Uzbek for Ahmadzai. Sagarika Dutt, a South Asian specialist at Notting- ham Trent University in England, said that Afghan- istan's electoral politics "are still based on ethnic allegiances and affiliations, rather than on policies." Next month's vote will also coincide with the height of the Taliban spring offen- sive that was launched ear- lier this week. The insur- gency has renewed its cam- paign of attacks on the Afghan police and military, increasing fears over secu- rity when voters head to the polls. The Taliban have pledged to disrupt the vote with bombings and other vio- lence, although the first round on April 5 passed rel- atively peacefully. Abdullah garnered 45 percent of votes in the first roundwhileAhmadzaicame in second with 31.6 percent, Independent Election Com- mission Chairman Ahmad Yousuf Nouristani said.
