The Dow Jones industrial average eked out its eighth straight day of gains, extending its longest advancing streak in nearly a year. The Dow has had only one down day in the last 11, on Jan. 28 when the protests in Egypt escalated. It last finished with eight straight days of gains in March 2010. It was the first down day for the index after four days of gains. The Nasdaq composite lost 7.98, or 0.3 percent, to 2,789.07. Two members of the Dow index reported better than expected earnings. Coca-Cola Co. said its income more than tripled last quarter, helped by the acquisition of a bottler and selling more drinks in North America. The stock rose 0.4 percent. Walt Disney Co. jumped 5.3 percent after reporting strong earnings after the market closed Tuesday. The company beat expectations thanks to higher revenues at its ABC and ESPN net- works. Disney helped push consumer discretionary stocks in the S&P index up 0.6 percent, the largest gain of any of the 10 com- pany groups that make up the index. Five Lucky Voters will be selected NEW YORK (AP) — EchoStar Corp.’s patent infringement case against rival TiVo Inc. will go for- ward, after a federal court lifted a stay on the suit on Tuesday. The case will pro- ceed even as TiVo awaits a ruling in its own seven-year- old patent infringement case against EchoStar . However, EchoStar, which rivals TiVo in the market for set-top boxes that record live television, is disputing just one patent, instead of the four original- ly named in the suit. The companies did not say when they expect the trial to begin. The patent pertains to a mechanism that controls how multimedia files are stored, formatted and ★★ take a charge of $4.1 bil- lion to build up reserves against losses for its accessed. TiVo “remains confi- dent” it didn’t infringe upon the patent, the company said in a statement Wednesday. The two companies’ legal battles date to 2004, when TiVo sued EchoStar, then the parent company of satellite television provider Dish Network Corp., for infringing on a key patent used in its digital video recorder set-top boxes, the one that allows consumers to rewind and fast-forward live TV. In 2005, EchoStar filed a countersuit against TiVo, alleging it violated four of its patents. NYSE Euronext Inc., the parent company of the exchange, issued a state- ment confirming that it was in advanced talks with Germany’s stock exchange, Deutsche Boerse, about a possible combination. The plan being discussed would create a company 60 per- cent owned by Deutsche Boerse shareholders with dual headquarters in Frankfurt and New York. NYSE Euronext’s stock jumped 14 percent to $38.10. Two stocks fell for every one that rose on the New York Stock Exchange. Consolidated volume came to 3.9 bil- lion shares. EchoStar’s patent case against TiVo going to trial case, pending the federal patent office’s re-examina- tion of the disputed patents. During that process, three of the patent claims were canceled, while TiVo petitioned, unsuccessfully, to dismiss the fourth. In 2008, while these re-exami- nations were under way, EchoStar spun off Dish Net- work as a separate compa- ny, though the two continue to share management and general counsel. Dish Network said in a statement that it was “pleased” that the stay was lifted and that it looked for- ward to the trial. As for TiVo’s case against EchoStar, a court awarded TiVo $200 million in damages, but EchoStar appealed the ruling. The companies made arguments in a hearing in November and are awaiting a ruling. EchoStar and Dish Net- work are both based in Englewood, Colo. TiVo is based in Alviso, Calif.
