Brief history: Defendant was contacted by officers after it was reported he invited the two minor victims to his storage unit to hang out. The officers received consent to search the storage unit and located pornographic videos and numerous photos of minors engaging in sexual conduct. Sentenced to 25 years to life in State Prison. People vs. John Curtis House, Assault with a Deadly Weapon with Special Allegations 16 Year Old Minor, Great Bodily Injury, Hate Crime, in Concert; Street Terrorism. Brief history: Defendant approached the African American victim and made derogatory and racial remarks towards her. Defendant then grabbed a hammer and hit the victim in the head. Sentenced to 10 years 8 months State Prison. People vs. Christopher James Hensley, Bring Drugs into a Jail with Special Allegation Prior Felony; Possession For Sale of a Controlled Substance, Possession of a Firearm by a Felon, Possession of Ammunition. Brief history: Defendant was originally granted formal probation. Defendant violated his probation when he failed to contact probation upon his release from custody and based upon his offense in NCR87619. Officers contacted defendant regarding a violation of his probation and found him in possession of a .40 caliber bullet as well as a .40 caliber semi-automatic pistol. The officers followed the vehicle to a gas station where the defendant exited the vehicle and entered the store. People vs. Jason Scott Harding, Second Degree Commercial Burglary with Special Allegation Prior Strike. Brief history: Defendant volunteered to clean a local church and ended up stealing several items from the church. Sentenced to 2 years 8 months State Prison. People vs. Richard Edward Haase Jr., Forgery with Prior Strike. Brief history: Officers responded to defendant's residence regarding a domestic disturbance. Upon arrival officers were advised defendant had struck the victim in the face. Defendant was arrested and during a search of his person officers located fictitious money in defendant's wallet. Sentenced to 2 years 8 months State Prison. People vs. Gilberto Galeana, Transportation of Marijuana Brief history: A deputy conducted a traffic stop on a vehicle driven by defendant. Upon contacting the defendant the deputy observed the odor of marijuana emitting from the vehicle. The deputy conducted a consent search of the vehicle and located a large amount of marijuana. Brief history: An officer contacted defendant after an employee of a business had detained him for shoplifting. The officer conducted a search of defendant's person and located methamphetamine in his possession. Defendant was released from custody on his own recognizance and failed to appear in court as required. Sentenced to 124 days county jail. People vs. Dominic Joseph Serrone, Possession of Concentrated Cannabis. Brief history: An officer conducted a traffic stop on a vehicle driven by defendant. Upon contacting the defendant the officer observed the odor of marijuana emitting from the vehicle. A search of the vehicle was conducted and the officer located marijuana and marijuana hashish. Sentenced to 90 days county jail. People vs. Ricky Tosh Eusted; Post Release Community Supervision. Brief history: Defendant was released from prison to post release community supervision. Defendant violated his terms of supervision when he failed to keep in contact with probation and keep them informed of his current contact information. Sentenced to 90 days county jail. People vs. Thomas Ross Hickman, Vandalism; Failure to Appear While on Bail. Brief history: Defendant threw a newspaper stand through the window of a local business. Brief history: Defendant was released from custody on her own recognizance and failed to appear in court as required. An officer conducted a traffic stop on a vehicle in which defendant was a passenger. The officer contacted the occupants of the vehicle and located hashish in defendant's possession. Defendant violated his probation when he was found in possession of alcohol, failed to complete his drug and alcohol treatment program and was found drunk in public. Sentenced to 60 days county jail. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confine- ment time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney's Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. People vs. Helen Elizabeth Sparks, Possession of a Controlled Substance. Brief history: Deputies responded to defendant's residence to search for a person who they knew had a felony warrant. The deputies received consent to search the residence and located methamphetamine. Defendant sentenced to Prop. 36 probation. Brief history: A deputy contacted defendant after receiving a report of a suspicious vehicle parked on private property. Inside defendant's vehicle the deputy located a marijuana pipe, marijuana and methamphetamine. Defendant was released from custody on his own recognizance and failed to appear in court as required.
