8A Daily News – Friday, November 22, 2013 Court Round-Up Recent State/Local Prison Commitments: People vs. Timothy Dale Smith-Possession of a Firearm by a Felon with Priors; First Degree Burglary with Special Allegation Offense While on Bail or O.R., -Grand Theft of a Firearm, -Possession of a Firearm by a Felon with Priors. Brief history: An officer contacted defendant and found him in possession of a firearm. Defendant and a companion forced their way into victim's residence, beat him, tied him up and threatened to kill him. The defendant and his companion ransacked the residence before leaving the scene. Sentenced to 9 years 4 months State Prison. People vs. Rigoberto Ponce Sanchez,Transport for Sale/Non-Contiguous County, False Compartment Activity. Brief history: An officer conducted a traffic stop on a vehicle driven by defendant. During a search of the vehicle the officer located a false compartment containing approximately 40 pounds of heroin. Sentenced to 9 years Local Prison. People vs. Jerrel Eugene Barron, Possession of a Controlled Substance with Special Allegation Prior Strike. Brief history: Agents conducted a parole search of defendant's property and located marijuana, hash, methamphetamine and a shotgun. Sentenced to 4 years State Prison. People vs. Steven Dean Woods, Second Degree Commercial Burglary; Unlawful Driving or Taking of a Vehicle. Brief history: Defendant was caught on a surveillance video breaking into a local business and stealing a vehicle and several other items. Victim reported her vehicle had been stolen. Officers later located the unoccupied vehicle and received information that the defendant was observed parking the vehicle and then taking off on foot. Defendant was eventually located and taken into custody. Sentenced to 3 years Local Prison. People vs. Christian Alexander Macedo, Evading an Officer, Willful Disregard, Driving While Having a 0.08% or Higher Blood Alcohol. Brief history: Defendant was originally granted formal probation. Defendant violated his probation when he was arrested for drunk in public and giving false information to a police officer. Sentenced to 2 years State Prison People vs. Howard Monroe Todd, Receiving Stolen Property. Brief history: Officers responded to a residence regarding a trespass call. Upon arrival officers located the defendant in possession of several bills and receipts belonging to the deceased owner of the residence. Sentenced to 16 months Local Prison. People vs. John Craig Skinner, Possession of a Controlled Substance, Driving When Privilege Suspended for Prior DUI; Possession of a Controlled Substance, Giving False Information to a Police Officer. Brief history: Defendant was originally granted formal probation. Defendant violated his probation when he failed to complete his drug and alcohol treatment program and failed to keep in contact with probation. Officers responded to a residence to conduct a warrant search and located the defendant hiding in a room. During a pat down search of the defendant the officers located methamphetamine. The officers later determined the defendant had given a false name at the time of his arrest. Sentenced to 16 months Local Prison. People vs. Joshua David White, Grand Theft Auto with a Prior. Brief history: Defendant was originally granted formal probation. Defendant violated his probation when he failed to complete his drug and alcohol treatment program. Sentenced to 1 year Local Prison. Recent County Jail Commitments: People vs. Nina Dee Mauricio, Arson of an Inhabited Structure or Property with Special Allegation Arson with Aggravating Factors. Brief history: Defendant poured gasoline on her vehicle and lit it on fire. Defendant then placed the gas can inside her residence and left the scene. The fire eventually spread from the vehicle to the residence. Sentenced to 270 days county jail. People vs. Ocean Sunflower Littlefield, Meeting Minor for Lewd Purposes, Contact with Minor for Sexual Offense, Possession of a Controlled Substance. Brief history: An undercover officer responded to an online advertisement posted by the defendant. The undercover officer was posing as a 15 year old female named "Trinity" and began communicating with the defendant through email. The defendant and "Trinity" eventually arranged to meet for sexual purposes. When the defendant arrived at the arranged location he was arrested and taken into custody. Sentenced to 180 days county jail. People vs. Juan Valencia, Carrying Loaded Handgun, Not Registered; Failure to Appear on Own Recognizance. Brief history: An officer conducted a traffic stop on a vehicle driven by defendant. The officer conducted a consent search of the vehicle and located a concealed loaded handgun with no registered owner. Defendant was released from custody on his own recognizance and failed to appear in court as required. Sentenced to 180 days county jail. People vs. Brandon Tyler Gray, Theft From Elder or Dependent Adult by a Caretaker. Brief history: Defendant was a caretaker for the victim and obtained his ATM card to make several unauthorized purchases from the victim's bank account. Sentenced to 180 days county jail. People vs. Norman Eugene Beckley, Escape. Brief history: Defendant was released from custody and placed on the electronic monitoring program. When defendant was contacted by an officer and ordered to provide a urine sample he took off on foot and cut off his ankle monitor. Defendant was eventually located and taken into custody. Sentenced to 122 days county jail. People vs. Anthony Montana Deuel, Escape. Brief history: Defendant was placed on the electronic monitoring program and cut off his ankle monitor and fled. Sentenced to 120 days county jail. People vs. Rafael Bustamante, Possession of a Controlled Substance, Resisting Arrest. Brief history: Deputies made a consensual contact with defendant and observed him to be displaying the symptoms of being under the influence of a controlled substance. As the officers attempted to detain the defendant he began to resist. After deputies gained control of defendant they conducted a search of his person and located methamphetamine and a methamphetamine pipe. Sentenced to 120 days county jail. People vs. Ryan Wesley Lamerrill, Failure to Register Upon Release, Incarceration. Brief history: Defendant failed to register as a sex offender upon his release from custody. Sentenced to 90 days county jail. People vs. Luke Mitchell III and Jeremy Isaac Mitchell, Possession of Marijuana for Sale. Brief history: An officer conducted a traffic stop on a vehicle driven by Luke and Jeremy was the passenger. As the officer contacted the defendants he observed the odor of marijuana emitting from the vehicle. The officer conducted a search of the vehicle and located several bags of marijuana. Sentenced to 90 days county jail. People vs. Kimberly Kelli Partida, Receiving Stolen Property. Brief history: A local business reported several of their ATVs had been stolen. Several weeks later an employee of the business was approached by the defendant and she offered to sell him one of the stolen ATVs. The employee contacted the police and defendant was arrested. Sentenced to 60 days county jail. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney's Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of noncompliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. People vs. Fallon Gail Smith, Possession of a Controlled Substance. Brief history: Defendant was a passenger in a vehicle that was stopped for a traffic violation. The driver was on searchable probation and a search of the vehicle was conducted. Defendant was found in possession of hydrocodone and methamphetamine. Defendant sentenced to Prop. 36 probation. Upcoming Court Dates Trials, Preliminary Hearings (PX) & Pre Trial Conferences (PTC): People vs. Brandon Ericson Branscombe, Murder, Assault on a Child Causing Death. Brief history: The 8 month old victim died as a result of injuries sustained while in the custody and care of defendant. Setting: December 3, at 8 a.m. in Department 3. People vs. Roger Sandy Bounnhaseng, Alan Duane Doulphus Jr., Chase Alan Doulphus: Felony murder, discharge of a firearm causing great bodily injury, second degree robbery, assault with a firearm, false imprisonment, transportation of marijuana. Brief history: The defendants went to a residence that contained a EVICTIONS $300 Attorney Fee + Costs FIXED COSTS: marijuana grow. The defendants confronted the victim and two other men who were at the residence and ordered them to the ground at gunpoint. The defendants proceeded to tie up the victim and the two men with zip ties and duct tape. The victim was able to free himself and attempt to flee the residence but was shot several times by the armed defendants. The victim eventually succumbed to his injuries. Defendant's vehicle was located a short time later and a vehicle pursuit followed. Defendant's were eventually apprehended and taken into custody. Inside the vehicle officers located a large amount of marijuana. Setting: December 3, at 8 a.m. in Department 3. People vs. Christopher Hougland, Murder with Special Allegation Use of Deadly Weapon, Assault With a Deadly Weapon with Special Allegation –Great Bodily Injury. Brief history: Officers responded to a residence regarding a disturbance. Upon arrival officers located the victim who appeared to have several stab wounds and was bleeding profusely. The victim eventually succumbed to his injuries and was pronounced dead at the scene. The defendant was arrested and taken into custody. Preliminary Hearing: December 12, at 1:30 p.m. in Department 2. People vs. Quentin Ray Bealer, Murder. Brief history: Defendant was arrested and charged with the murder of a 14 year old victim who had been reported missing when she never returned home from school. Officers located the victim's body two days later. Preliminary Hearing: January 23, 2014 at 1:30 p.m. in Department 4. People vs. Daniel Llamas & Isabelle Deanna Rios, Child Abuse with Special Allegation Willful Harm or Injury Resulting in Death. Brief history: The 13 month old victim died as a result of injuries sustained while in the custody and care of Llamas and Rios.
