Agents from the drug task force conducted a search of Ames’ vehicle and located several grams of metham- phetamine and marijuana packaged in numerous bags. Agents also located syringes, a scanner and several thou- sands of dollars in cash. Agents from the drug task force served a search warrant on Ames and inside his vehi- cle located a large amount of marijuana and methampheta- mine which were packaged in numerous bags. Agents also located a digital scale, pack- aging material and several thousands of dollars in cash. Inside defendant’s residence agents located another large amount of marijuana pack- aged in numerous bags. • Samuel Isael Ayala was sentenced to 9 years in state prison for assault with a firearm with special allega- tions -use of firearm, dis- charge of firearm with gross negligence, possession for sale of a controlled substance with special allegation- spe- cial allegation-personally armed/firearm controlled substances, street terrorism; bribing an executive officer. Officers were dispatched to the parking lot of a local bar for a report of a fight in progress. While offi- cers were responding dis- patch advised them there had now been a report of shots fired at that location. Upon arrival officers contacted the victim who stated he had observed two females fight- ing in the parking lot and decided to intervene in an attempt to stop the fight when he was attacked by three His- panic males. During the struggle Ayala retreated to his car where he removed a hand- gun and fired two gunshots into the sky. Officers were able to locate Ayala and take him into custody without incident. Ayala was being arrested for outstanding war- rants when he offered money to an officer if he would let him go. • Rogelio Gallegos Salto was sentenced to three years in state prison for transporta- tion of marijuana. A deputy conducted a traf- fic stop on a vehicle driven by Salto. While contacting Salto the deputy observed the odor of marijuana emitting from the vehicle. A search revealed two large bags of marijuana located in the bed of the truck. • Amanda Lee Graham was sentenced to 2 years in state prison for grand theft. Victim reported money from his checking account had been stolen. An investi- gation into the incident reveals Graham activated the ATM card that was mailed to the victim and was caught on surveillance video using it at several locations. • Brian Wayne Cunning- ham was sentenced to 2 years in state prison for three counts of second degree com- mercial burglary. Cunningham stole the vic- tim’s bank card and used it at several stores to purchase items. A clerk at one of the stores recognized the card holder and refused to accept the card from Cunningham. Cunningham was later con- tacted while in custody on another matter. Recent County Jail Com- mitments: • Robert Williamson was sentenced to 180 days in Tehama County Jail for grand theft. Williamson and two other men stole some copper wire from a local business and sold it to a recycling center for profit. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney’s Office. Per the requirements of Proposition 36, a defendant who possess- es drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on pro- bation and require drug treat- ment alone. Per the require- ments of Proposition 36, only upon a third drug related pro- bation violation may the court impose confinement time. In the event the defen- dant violates a non-drug related term of probation the court may then elect to sen- tence defendant to jail or prison. The Tehama County Dis- trict Attorney’s Office con- tends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treat- ment and jail time. We fur- ther contend that in other spe- cific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sen- tence should properly be imposed. • Dena Marie Elder was sentenced to Prop. 36 proba- tion for possession of a con- trolled substance. Officers conducted a search of Elder’s residence and located two methamphet- amine pipes as well as mari- juana and methamphetamine found in Elder’s purse. • Mark Clay Blankenship was sentenced to Prop. 36 probation for possession of a controlled substance. Officers respond to a resi- dence that was on fire. Offi- cers then contacted Blanken- ship who told officers he had started the fire to his own house. After a search of Blak- enship’s person officers located several Norco pills in his pocket. Recent Filings: • Franklin William Johnson will appear in court at 8 a.m. on Dec. 7 in Department two for felony arraignment. He is facing the charges of assault by means likely to produce great bodily injury, battery with seri- ous bodily injury, special alle- gation-great bodily injury, two counts. Officers were dispatched to an alley regarding a physical disturbance. Upon arrival offi- cers contacted the parties involved and were advised defendant and victim had got- ten into an argument. Victim took off on foot and Johnson followed in his truck. Victim grabbed an object in an attempt to defend himself when John- son attacked him. Victim was transported to the hospital with a broken neck. Upcoming Court Dates - Trials, Preliminary Hear- ings(PX) & Pre Trial Confer- ences(PTC): • Chrissy Ann Dunn will appear in court at 1:30 p.m. on Nov. 30 in Department three. She is facing the charges of unlawful sexual intercourse, lewd act upon a child, oral cop- ulation of a person Under 16. Officers receive information that Dunn had sexual relations with a 14-year-old victim.
