Monday, November 1, 2010 – Daily News – 5B Court Round-Up The following defendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney’s Office: —————— Recent State Prison Com- mitments: • Michael Kiss was sen- tenced to three years, eight months in state prison for felon in possession of a firearm, pro- hibited person owning ammu- nition and transporting or sell- ing a controlled substance. An officer contacted Kiss after being flagged down for directions. While speaking with Kiss the officer noticed a box of ammunition inside the car. Kiss said he had a gun in the trunk of his vehicle. The officer then searched the trunk where he located an unloaded firearm. The officer confirmed Kiss was a convicted felon and was taken into custody. Kiss was a passenger in a vehicle that was stopped for a vehicle code violation. Prior to the vehicle being towed agents searched it and located methamphetamine, a glass smoking pipe and a small amount of marijuana. • Shannon Michelle Son was sentenced to three years, eight months in state prison for transporation of a controlled substance, possession of a deadly weapon, possession of a controlled substance, posses- sion of a controlled substance. Son was a passenger in a vehicle that was stopped for a vehicle code violation. After obtaining consent to search the vehicle the officer located a set of brass knuckles as well as methamphetamine that was found hidden in Son’s pants. Son was originally granted for- mal probation. She violated her probation when she left her residential treatment program and failed to inform probation of her location. • Sharla Lee Smith was sen- tenced to two years in state prison for bringing drugs into a jail. Smith was a passenger in a vehicle stopped for a vehicle code violation. After a search of the vehicle Smith was taken into custody after the deputy located oxycontin pills inside the vehicle. While at the jail Smith first denied having any- thing illegal on her person but during the booking process defendant admitted she had a methamphetamine pipe in her pants. Recent County Jail Com- mitments: • Jaron Lee Carnahan was sentenced to 200 days in Tehama County Jail for pos- session of a controlled sub- stance, possession of a deadly weapon, failure to appear while on bail. An officer conducted a traf- fic stop on a vehicle driven by Carnahan for a vehicle code violation. The officer was advised that Carnahan had warrants for his arrest. The officer then searched Carnahan and located methampheta- mine. Officers contacted Car- nahan and arrested him on an outstanding warrant. During a search of his residence officers located a nunchaku. Carnahan was previously released on bail and failed to appear in court as ordered. • Emmett Franklin Dancer was sentenced to 120 days in Tehama County Jail for dri- ving with a .08 percent blood alcohol causing injury, special allegation-bodily injury, spe- cial allegation-great bodily injury. Dancer was originally granted formal probation. He violated his probation when he was cited for driving with an expired license and being in possession of of marijuana. In the event the defendant violates a non-drug related term of probation the court may then elect to sen- tence defendant to jail or prison. The Tehama County Dis- trict Attorney’s Office con- tends that each criminal case is unique and that in certain, spe- cific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a histo- ry of non-compliance with either previous grants of pro- bation or previous grants of drug treatment, a state prison sentence should properly be imposed. • Scott Rex Mills was sen- tenced to Prop. 36 probation for possession of a controlled substance. A deputy conducted a traf- fic stop on a vehicle driven by Mills. After confirming Mills was unlicensed he was taken into custody. While at the jail Mills was found to be in pos- session of methamphetamine. Upcoming Court Dates - Trials, Preliminary Hearings(PX) & Pre Trial Conferences(PTC): • Gann Bradford Gannon will appear in court at 1:15 p.m. on Nov. 1 in Department 2 for a pre-trial conference. He is facing 20 counts of the charge of grand theft of per- sonal property(20 counts). Gannon owned a local car lot and sold cars to various people. During many of the sales defendant failed to pay the DMV fees. Defendant also sold extended warranties on the vehicles but instead of pay- ing the warranty company defendant kept the money leaving many vehicle owners without their warranties. • Karl Mora Rottman will appear in court at 1:30 p.m. Nov. 1 in Department 1 for sentencing. He is facing the charges of false compartment to conceal drugs, sale of a con- trolled substance, sale of mari- juana. Rottman was originally granted formal probation on both cases. He violated his probation when he failed to contact probation and advise them of his current address as well as testing positive for methamphetamine. • Michael Ryan Ogier will appear in court at 8 a.m. on Nov. 2 in department 3. He is facing the charges of assault with intent to commit a felony, attempt: forcible oral copula- tion, sexual battery by restraint. Deputies were dispatched to a residence where they received information that Ogier attempted to physically force himself onto the victim. Deputies were further advised that during the incident the victim was able to pull herself away from Ogier and get to a window to yell for help. A short time later a neighbor entered the residence and pulled Ogier off of the victim. • Ross Evan Rottman will appear in court at 1:30 p.m. on Nov. 8 in Department 1. He is facing the charges of culitvat- ing marijuana, possession of marijuana for sale. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confine- Agents from the drug task force served a search warrant at a residence where they contacted Rottman. During the search of the residence agents located forty-four mari- juana plants and two firearms. • Dickie Wayne Puckett will appear in court at 1:15 p.m. on Nov. 8 in Department 2. He is facing the charges of D.U.I. causing injury,driving with a .08 percent blood alcohol causing injury, special allega- tion-Over .15 percent blood alcohol, special allegation- great bodily injury, four counts of special allegation-bodily injury to more than one victim. Officers respond to a traffic collision involving injuries. Upon arrival officers contacted Puckett who appeared to be under the influence of alcohol. Upon speaking with Puckett officers observed his speech to be slurred as well as Puckett being very unsteady on his feet. Puckett was then arrested and taken into custody. The victims in the other car all received injuries as a result of this collision and were trans- ported to the hospital.
