6A– Daily News – Thursday, August 5, 2010 Recent State Prison Commitments: 1. TCSO – People vs. Humberto Sandoval Moctezuma, Corporal Injury to Cohabitant, Special Allegation-GBI- Domestic Violence. Brief history: Deputies respond to a domestic disturbance between defendant and victim. Upon contact- ing the victim it appeared she had been severely beaten. An investigation into the incident revealed the defendant had beaten the victim with a large wooden pole causing severe injuries to her head and body. Sentenced to 9 years State Prison. 2. CPD – People vs. Kenneth Jason Sams, First Degree Residential Burglary. Brief history: Victim was asleep at her home when she awakens and finds defendant and another man in her home. The defendant and the other man then flee when they see the victim. Offi- cers arrive at the home and find a ladder next to the kitchen window, pry marks on the window, gloves and other clothing items near the home. Sentenced to 6 years State Prison. 3. TCSO – People vs. Jerame Wayne Clark, Transportation of a Con- trolled Substance, Special Allegation-Prior Felony, Special Allegation-Prior Strike, Driving While Have a 0.08% or Higher Blood Alcohol. Brief history: A deputy conducted a traf- fic stop on a vehicle dri- ven by the defendant. Upon contacting the defendant the deputy noticed an odor of alco- hol and the defen- dant to be unsteady on his feet as he exited his vehi- cle. The deputy then located a bag of Psilocy- bin mushroom in defen- dant’s sock. Sentenced to 6 years State Prison. 4. TCSO – People vs. Kelly Jean Ranberg, Petty Theft With a Prior; Sale or Transportation of Mar- ijuana. Brief history: Defen- dant had stolen victim’s ATM card from her home and made several unau- thorized purchases. Deputies then contacted defendant who admitted to the theft. Defendant was originally granted formal probation. Defen- dant violated her proba- tion as a result of her new charges in NCR79116. Sentenced to 4 years 8 months State Prison 5. RBPD – People vs. Robert Allen Jones, Sec- ond Degree Commercial Burglary, Special Allega- tion-Two Prior Felonies. Brief history: Defen- dant was originally grant- ed formal probation. Defendant violated his probation when he failed to complete the drug and alcohol program and failed to keep appoint- ments with probation. Sentenced to 4 years State Prison. 6. TIDE – People vs. Steven Angle, Possession of a Controlled Sub- stance, PC667.5(b), Spe- cial Allegation-Prior Felony. Brief History- Defendant was originally granted formal probation. Defendant violated his probation when he failed to complete his Proposi- tion 36 treatment pro- gram. Sentenced to 3 years State Prison 7. RBPD – People vs. Saulo Daniel Eduardo & Eric Roberts, PC211, 2nd Degree Robbery. Brief history: Both victims and defendants were walking on opposite sides of the street when the defendants asked the victims for some ciga- rettes and a dollar. When the victims stated they did not have any, defen- dant Roberts pulled out knife and held them both a knife point demanding they empty their pockets. The defendants then fled the area and were later arrested and taken into custody. Sentenced to 3 years State Prison (Eric Roberts) Sentenced to 270 days county jail. (Saulo Eduar- do) 8. TCSO – People vs. Vita Anne Benchasky, Possession of a Con- trolled Substance; Aid by Misrepresentation-Over $400. Brief history: A deputy conducted a traf- fic stop on a vehicle dri- ven by the defendant. The deputy obtained consent to search the vehicle. During the search of the vehicle the deputy observed defendant reach in her shirt and then put something on a nearby fence. A search of that area revealed 3.6 grams of methamphetamine found near the fence and a glass smoking pipe was found which was found inside the vehicle. Defendant was origi- nally granted formal pro- bation. Defendant violat- ed her probation as a result of her new charges. Sentenced to 2 years 8 months State Prison. 9. RBPD - People vs. Jaimie Geane Sims, Resisting Executive Offi- cer. Brief history: Defen- dant was a passenger in a vehicle that was stopped because it met the description of a vehicle that was seen leaving the scene of a physical dis- pute. As the officer attempted to detain defendant she struck the officer in the face. After a brief struggle the officer was able to gain control of defendant and take her into custody. Sentenced to 2 years State Prison. 10. CPD - People vs. Richard Allyn Denny, Second Degree Commer- cial Burglary. Brief history: The vic- tim reported her credit card and debit card had been stolen from her car. After contacting the bank the victim was advised that there had been sever- al unauthorized purchas- COURT ROUND-UP Brief history: Defen- es on the card. An officer was then able to obtain the store surveillance video from one of the locations the card was used and further was able to identify the defendant on the video. Sentenced to 16 months State Prison. Recent County Jail Commitments: 11. DABI – People vs. Deborah Simonsen & James Simonsen, Aid by Misrepresentation. Brief history: Defen- dants were receiving food stamps and claiming they were homeless and had no income. Investigators determined Deborah Simonsen was receiving monthly gaming benefits of $3,800 from an Indian Tribe while still collect- ing food stamps and claiming no income. Sentenced to 270 days county jail (Deborah Simonsen) Sentenced to 180 days county jail (James Simonsen) 12. TCSO - People vs. Steven Curtis Vanlent, & Daniel Jesse Humphrey; Receiving Stolen Proper- ty; Receiving Stolen Property. Brief history: Defen- dants steal two motorcy- cles from the fairgrounds, load them up in a truck and take them to Van- lent’s residence. When deputies serve a search warrant at Vanlent’s resi- dence they contact Van- lent who admitted to the theft at the fairgrounds. Humphreys stated he sold one of the motorcycles to Justin Vandoorn. Deputies were then able to locate one of the stolen motorcycles at Van- doorn’s residence but were unable to recover the other stolen motorcy- cle. Sentenced to 90 days county jail. (Daniel Humphrey) Sentenced to 120 days county jail. (Steven Van- lent) 13. DABI – People vs. Christopher Allen Quinn, Aid by Misrepresenta- tion-Over $400. Brief history: Defen- dant was originally grant- ed formal probation. Defendant violated his probation when he sub- mitted a urine sample that tested positive for methamphetamine. Sentenced to 60 days county jail. 14. TCSO – People vs. Maria Medina, Grand Theft of Personal Proper- ty. Brief history: Defen- dant approached the vic- tim in a casino and began a conversation. The vic- tim had placed a voucher worth $592.70 on top of her slot machine and while being distracted the defendant grabbed vic- tim’s voucher. Defendant then exchanges the voucher for another worth $28 and handed it to the victim and walked away. Sentenced to 60 days county jail. 15. RBPD - People vs. Edward Frank Flickinger Jr., Petty Theft With a Prior. dant was originally grant- ed formal probation. Defendant violated his probation when he failed to complete his drug and alcohol class, admitted to smoking methampheta- mine and was found in possession of alcohol. Sentenced to 30 days county jail. Recent Proposition 36 Commitments: Note: All cases where- in a defendant is sen- tenced per the terms of Proposition 36 are not at the request of the Tehama County District Attor- ney’s Office. Per the requirements of Proposi- tion 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on proba- tion and require drug treatment alone. Per the requirements of Proposi- tion 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non- drug related term of pro- bation the court may then elect to sentence defen- dant to jail or prison. The Tehama County District Attorney’s Office contends that each crimi- nal case is unique and that in certain, specific, cases a defendant should be sentenced to a combi- nation of drug treatment and jail time. We further contend that in other spe- cific cases where a defen- dant has an extensive criminal record and/or a history of non-compli- ance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. 16. TCSO – People vs. Deborah Star Simonsen, Possession of a Con- trolled Subtance; Aid by Misrepresentation. Brief history: The defendant was contacted by deputies and consent- ed to a search of the vehi- cle she was riding in. The deputy was able to locate a usable amount of methamphetamine and a smoking pipe. Defendant sentenced to Prop. 36 probation. Preliminary Hear- ings (PX) and Trials: 17. TIDE - People vs. Joseph Dailey Froome, Cultivating Marijuana; Possession of Marijuana For Sale, Money Laun- dering (8 counts). Brief history: Agents served a search warrant at the defendant’s ware- house off of Baker Road in Red Bluff. Inside they found over 400 marijuana plants. TIDE agents also located over 30 pounds of processed marijuana. PX Date: September 23, 2010 at 9:00 a.m., Check with Court for Department 18. TIDE - People vs. Daniel Miguel Ludwig, Cultivating Marijuana; Possession of Marijuana For Sale. Brief history: Agents served a search warrant at the co-defendant’s ware- house off of Baker Road in Red Bluff. Inside they found over 400 marijuana plants. TIDE agents also located over 30 pounds of processed marijuana. PX Date: September 23, 2010 at 9:00 a.m., Check with Court for Department 19. TCSO - People vs. William Holt Baymiller, 2nd Degree Murder Brief history: The Tehama County Sheriff’s Office received a 911 call from a man who said that defendant showed up at his house and claimed he just shot and killed his dad. Defendant showed the man his California Driver’s License. Deputies arrive and locate the defendant at his father’s home armed with a shotgun. The Sheriff’s office takes defendant into custody after a brief stand-off. Upon entering the residence, TCSO locates the victim with a fatal gunshot wound to the chest. Defendant claims that he was going to be killed by "Muslims" and he "believed" that his dad was in on it. Trial Date: September 28, 2010 at 9:00 a.m. in Department 2 20. CPD - People vs. Steven Arcangelo Piazza, Murder Brief history: Corning Police Department received a call from Steven Piazza around 5:30 am on November 23, 2009 stating he thought he had killed a woman. When police went to check on the victim they received no response. Officers forced entry into the home and found the victim lying on the kitchen floor. The victim was found dead at the scene. She had suffered a severe beating and had deep lacerations on the back of her head. Piazza was arrested shortly thereafter without inci- dent. Trial Date: October 6, 2010 at 9:00 a.m. in Department 3 21. RBPD - People vs. David Keith Weinkauf, 2 Counts, Assault on Peace Officer/Firefighter with Semiautomatic Firearm; 2 Counts, Possession of a Deadly Weapon. Brief history: Officers were dispatched to a report of a suicidal per- son. Upon contacting the individual who was sit- ting outside of an apart- ment, RBPD officers determined that the defendant was a former Tehama County Animal Control Officer, who in the past had expressed suicidal desires. Defendant, armed with a semi-automatic handgun, was repeatedly instructed to "put the gun down" by the officers. Instead, defendant pointed the gun at the officers. Offi- cers fired upon the defen- dant. Defendant’s hand- gun was located at the scene. Trial Date: October 6, 2010 at 9:00 a.m., Check with Court for Depart- ment 22. RBPD – People vs. Samuel Isael Ayala and Everado Barragan, Assault With a Firearm With Special Allegations Use of Firearm, Street Terrorism-Violent Felony(Ayala only); Dis- charge of Firearm With Gross Negligence With Special Allegation Street Terrorism-Violent Felony (Ayala only); Having concealed Firearm on Person With Special Allegation Street Terror- ism (Ayala & Barragan), Transportation of a Con- trolled Substance With Special Allegation Armed With Firearm (Ayala & Barragan), Pos- session For Sale of a con- trolled Substance With Special Allegation (Ayala & Barragan), Street Ter- rorism (Ayala & Barra- gan), Battery: Simple (Barragan only) Brief history: Officers were dispatched to the parking lot of a local bar for a report of a fight in progress. While officers were responding dispatch advised them there had now been a report of shots fired at that loca- tion. Upon arrival offi- cers contacted the victim who stated he had observed two females fighting in the parking lot and decided to intervene in an attempt to stop the fight when he was attacked by three Hispan- ic males. During the struggle one of the defen- dants retreated to his car where he removed a handgun and fired two gunshots into the sky. Officers were able to locate defendants and take them into custody without incident. Trial Date: October 20, 2010 at 9:00 a.m., Check with Court for Department 23. TCSO - People vs. Jose Guadalupe Ramirez and Elfego Chavez Acevedo aka Elfego Acevedo Chavez Car- jacking, 2nd Degree Rob- bery, Kidnapping for Car- jacking, each charge with a Special Allegation of Use of Firearm. Brief history: A Tehama County man received a phone call from a friend requesting a ride from Redding back to Red Bluff for her "2 cousins." The Red Bluff man agreed and drove to Redding to meet with all three peo- ple. The Victim’s friend and her "two cousins" got into the Victim’s car and traveled toward Tehama County based on the directions provid- ed by Ramirez. Victim stops his car and Ramirez puts a gun to Victim’s head and demands the car and orders him out. Acevedo prones the Victim out on the ground and steals his wallet and cell phone. Approximately 4 hours later, Red Bluff Police Department officers locate and stop the stolen car and arrest Ramirez. Acevedo flees and is eventually arrest- ed. Trial Date: September 15, 2010 at 9:00 a.m., Check with Court for Department. PBS program tonight explores Civil War battle The Battle of Gettysburg, considered the turning point in the Civil War, is the focus of a special program airing at 8 p.m. Thursday on north state public television station KIXE.’ "The Universe of Battle," from Ken Burns’ celebrated documentary on the Civil War, chronicles the three-day battle where some 150,000 men fought to the death in the Penn- sylvania countryside. The program includes the fall of Vicksburg, the New York draft riots and the first use of black troops. It closes with Lincoln’s Gettysburg Address.
