8A Daily News – Friday, July 12, 2013 COURT ROUND-UP Recent State/Local Prison Commitments: People vs. Christopher William Clark - Commercial Burglary with Special Allegation Offense While on Bail or O.R. and Special Allegation Prior Strike. Brief history: Defendant entered a local business, grabbed several items and proceeded to leave the store without paying for the items in his possession. Sentenced to 8 years State Prison. People vs. Robert Lloyd Perozzi, Corporal Injury to Co-Habitant with Special Allegation Prior Felony. Brief history: Defendant and the victim began arguing which escalated into a physical altercation when the defendant threw the victim down on the floor, grabbed her hair and hit her head on a door. Sentenced to 7 years State Prison. People vs. Emery David Stueart, Carrying a Dirk or Dagger with Special Allegation Prior Strike. Brief history: An officer made contact with defendant and found him in possession of a fixed blade knife concealed under his jacket. Sentenced to 5 years 4 months State Prison People vs. Zaccari Arthur Lee Hice, Driving While Having a 0.08% or Higher Blood Alcohol-Two Prior DUI's. Brief history: An officer conducted a traffic stop on a vehicle driven by defendant. Upon contacting the defendant the officer observed the defendant displaying the symptoms of intoxication. The defendant submitted a breath sample over the legal limit and was subsequently taken into custody. Sentenced to 3 years Local Prison. People vs. James William Mitchell, Vandalism Over $400. Brief history: Defendant was originally granted formal probation. Defendant violated his terms of probation when he tested positive for alcohol. Sentenced to 16 months Local Prison. Recent County Jail Commitments: People vs. Mary Lee O'Connor, Assault With a Deadly Weapon with Special Allegation GBI-Domestic Violence. Brief history: Defendant and victim began arguing when the defendant stabbed the victim in the neck with a knife. Defendant was arrested and taken into custody. Sentenced to 269 days county jail. People vs. Dallin Edward Foster, Grand Theft Auto. Brief history: Defendant was originally granted formal probation. Defendant violated his terms of probation when he was found in possession of prescription medication without a prescription. Sentenced to 180 days county jail. People vs. Arleen Marie Morton, Embezzlement by Public or Private Officer. Brief history: Defendant had been working for a local business when over a period of several years she began making payments to her personal credit cards using funds from the business account. The defendant had embezzled approximately $75,000 from the business. Sentenced to 180 days county jail. People vs. Scott Waid Reid, Providing Lewd Material to a Minor. Brief history: An officer posted an online advertisement posing as a 15-year-old female. The defendant responded to the advertisement and arranged a place to meet for sexual purposes. When the defendant arrived at the arranged location he was arrested and taken into custody. Sentenced to 120 days county jail. People vs. Eli William Gosnell, Transportation of a Controlled Substance, Possession of Marijuana For Sale. Brief history: Defendant was originally granted formal probation. Defendant violated his probation when he tested positive for marijuana and methamphetamine. Sentenced to 120 days county jail. People vs. Irma Nunez, Cultivating Marijuana. Brief history: Officers served a search warrant on defendant's property and located several marijuana plants growing. Sentenced to 90 days county jail. People vs. John Patrick Bailey, Possession of a Controlled Substance with Special Allegation Prior Felony. Brief history: Defendant was originally granted formal probation. Defendant violated his probation when he absconded from probation, failed to appear in court and tested positive for methamphetamine. Sentenced to 90 days county jail. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County Dis- trict Attorney's Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. People vs. Marci Marie Calarruda, Possession of a Controlled Substance with Special Allegation Prior Strike. Brief history: An officer contacted defendant after she was observed riding a bicycle a night without a light. The defendant was found in possession of methamphetamine and a glass pipe and was subsequently taken into custody. Defendant sentenced to Prop. 36 probation. People vs. Michael Joseph Grissom, Possession of a Controlled Substance. Brief history: An officer observed the defendant on the property of a business in the early morning hours. The officer attempted to make contact with the defendant when he suddenly jumped on his bike and fled. The officer located the defendant a short time later and found him in possession of methamphetamine and syringes. Defendant sentenced to Prop. 36 probation. Upcoming Court Dates Trials, Preliminary Hearings & Pre Trial Conferences: People vs. Christopher Hougland, Murder with Special Allegation Use of Deadly Weapon, PC245(a)(1)Assault With a Deadly Weapon with Special Allegation Great Bodily Injury. Brief history: Officers responded to a residence regarding a disturbance. Upon arrival officers located the victim who appeared to have several stab wounds and was bleeding profusely. The victim eventually succumbed to his injuries and was pronounced dead at the scene. The defendant was arrested and taken into custody. Entry of Plea/Setting: July 16 at 8 a.m. in Department 2. People vs. Daniel Llamas & Isabelle Deanna Rios, Child Abuse with Special Allegation Willful Harm or Injury Resulting in Death. Brief history: The 13month-old victim died as a result of injuries sustained while in the custody and care of Llamas and Rios. Preliminary Hearing: July 16, 1:30 p.m. in Department 2. (Llamas) PTC: July 29, 2013 at 1:15 p.m. in Department 3. (Rios) People vs. Dustin Lee Hedrick, Lewd Act Upon a Child, Child Molesting. Brief history: Defendant was a 19-year-old Boy Scout troop leader and both minor victims were Boy Scouts. Defendant went to a party at one of the victim's homes during which he committed lewd and lascivious acts upon the two victims. Further Proceedings/Sentencing: Aug. 6, at 10 a.m. in Department 2. People vs. Brandon Ericson Branscombe, Murder. Brief history: The 8month-old victim died as a result of injuries sustained while in the custody and care of defendant. Preliminary Hearing: Aug. 13, at 1:30 p.m. in Department 2. People vs. Quentin Ray Bealer, Murder. Brief history: Defendant was arrested and charged with the murder of a 14 year old victim who had been reported missing when she never returned home from school. Officers located the victim's body two days later. Preliminary Hearing: Oct. 2, at 9 a.m. in Department 3.
