There is more, but you get the point. — Christian in Aptos COURT ROUND-UP The following defendants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney's Office: —————— Recent State Prison Commitments • Liet Phou was sentenced to nine years and eight months in state prison for transport for sale/noncontiguous county, false compartment activity. An officer conducted a traffic stop on a vehicle driven by Phou. The officer's K-9 alerted on the vehicle and a search was conducted. Inside a hidden compartment within the vehicle the officer located a large amount of cocaine. • Matthew Lyle Milliman was sentenced to four years in state prison for possession of metal knuckles with special allegationprior felony. Milliman was originally placed on formal probation. He violated his terms of probation when he failed to keep in contact with probation, he was arrested and convicted in another county and he failed to appear in court. • Lauretha Dawn Starnes was sentenced to two years and eight months in state prison for possession of a controlled substance; commercial burglary. Starnes was originally placed on formal probation for both cases. She violated her terms of probation when she tested positive for methamphetamine, failed to complete her drug and alcohol treatment program and failed to appear in court and at probation. • Miguel Sanchez Salamanca was sentenced to two years and eight months in state prison for possession for sale of a controlled substance, false compartment activity. An officer conducted a traffic stop on a vehicle driven by Salamanca. Upon contacting Salamanca the officer's K-9 alerted on the vehicle and a search was conducted. Inside a hidden compartment the officer located methamphetamine. • Garland Spencer was sentenced to two years and eight months in state prison for petty theft with a prior; post release community supervision. An officer contacted Spencer in the parking lot of a grocery store. The officer observed the odor of alcohol emitting from Spencer and found a bottle of alcohol in Spencer's waistband. The officer learned the alcohol had been stolen from the grocery store and Spencer was taken into custody. Spencer was released from prison to post release community supervision. He violated his terms of supervision based upon his arrest in NCR86159. • Valentin Paz Servin was sentenced to two years in state prison for perjury. Deputies were investigating an incident and discovered Servin had used a false name and social security number on official government documents. Recent County Jail Commitments • John Richard Kannon was sentenced to 180 days in Tehama County Jail for evading an officer, willful disregard. Kannon was driving his motorcycle at a high rate of speed and failed to yield after an officer attempted to conduct a traffic stop. A pursuit ensued and Kannon continued to drive at a high rate of speed until he eventually crashed and bailed on foot. Kannon was apprehended by a police K-9 and taken into custody. • Daniel Coleman Cahalan was sentenced to 180 days in Tehama County Jail for post release community supervision. Cahalan was released from prison to post release community supervision. He violated his terms of supervision when he failed to keep in contact with probation. • Tanner Jack Walden was sentenced to 120 days in Tehama County Jail for second degree commercial burglary. Walden was originally granted formal probation. He violated his probation when he failed to contact probation and failed to report to jail to serve his sentence. • Brandon Bear Allen was sentenced to 120 days in Tehama County Jail for resisting executive officer; post release community supervision. A deputy made a consensual contact with Allen and observed an odor of marijuana on him. The deputy had knowledge that Allen had absconded from probation and attempted to detain him. Allen began to resist and fight with the deputy until he was eventually placed into handcuffs. Allen was released from prison to post release community supervision. Allen violated his terms of supervision when he failed to keep in contact with probation and as a result of his arrest in NCR86299. • Ronnie Bud Davis was sentenced to 90 days in Tehama County Jail for unlawful driving or taking of a vehicle. Davis entered an unlocked vehicle which had the keys in the ignition. He drove away in the vehicle but was caught a short time later. Recent Proposition 36 Commitments Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney's Office. Per the requirements of Proposition 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on probation and require drug treatment alone. Per the requirements of Proposition 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug related term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney's Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sentenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of noncompliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. • Tyler James Novack was sentenced to Prop. 36 probation for possession of a controlled substance. An officer contacted Novack who was parked on the side of the road in his vehicle. The officer observed an odor of marijuana on Novack and conducted a search. The officer located marijuana and cocaine on Novack's person. • Kristionna Anne Quaid was sentenced to Prop. 36 probation for transportation of marijuana. A deputy conducted a traffic stop on a vehicle driven by Quaid.
