4B – Daily News – Friday, July 2, 2010 The following defen- dants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney’s Office: —————— Recent State Prison Commitments: • Christopher Calvin Fackrell was sentenced to six years, eight months in state prison for possession for sale of a controlled sub- stance, special allegation- controlled substance prior, possession of ammunition. A deputy conducted a traffic stop on a vehicle dri- ven by Fackrell and was advised by dispatch that Fackrell had a warrant for his arrest. The deputy then searched the vehicle and located digital scales, methamphetamine and a semi automatic pistol. • Paul James Wright was sentenced to six years in state prison for assault with a deadly weapon-special allegation-great bodily injury. Wright and another man encountered the two vic- tims while walking along- side opposite sides of the street on New Years Eve. An argument ensued and the victims approached Wright and the other man. Both victims ended up get- ting beat with a chain and stabbed several times in the abdominal area and hands. • Rebecca Lynnette Wiley was sentenced to three years in state prison for grand theft. The victim needed assis- tance and provided Wiley with her ATM card to pur- chase certain items that the victim needed. The victim later discovered that there had been several COURT ROUND-UP stance. unauthorized withdrawals totaling about $11,450. • Roger Lee Hayden, Jr., was sentenced to two years, eight months in state prison for possession of ammuni- tion; carry a dirk or dagger; receiving stolen property. Deputies responded to a residence after a man had reported Hayden was tres- passing on his property. When deputies arrived they contacted Hayden and located a knife in his pock- et. Deputies also located Hayden’s truck a short dis- tance from the residence and found a box of ammu- nition inside. Deputies then questioned a neighbor who reported hearing someone near her shed by the pool. When confronted Hayden claimed he was there to clean the pool. Victim reported that Hay- den had stolen a mobile phone from his residence and later returned it. Victim then realized that his radio scanner was also missing. When officers confronted Hayden he denied stealing the scanner but officers could see the antenna stick- ing out of his pocket. • Earl Patrick Jackson was sentenced to two years in state prison for petty theft with a prior. Jackson was caught stealing a bottle of alcohol from a local supermarket and then leaving the store without paying for the item. When officers contacted Jackson he denied stealing the alcohol but admitted to stealing some cheese. • Jason Joseph Haines was sentenced to two years in state prison for posses- sion of a controlled sub- Haines was originally granted formal probation. He violated his probation when he punched and choked another person while being under the influ- ence of alcohol. • Mark Steven Autry was sentenced to two years in state prison for failure to update registration annual- ly. Autry is a registered sex offender and failed to com- ply with his registration requirements. • David Shane Ables was sentenced to two years in state prison for posses- sion of a controlled sub- stance; possession of a con- trolled substance. Ables was originally granted formal probation. He violated his probation when he tested positive for methamphetamine. • Ruben Soliz was sen- tenced to two years, eight months in state prison for possession of a controlled substance; two counts of second degree commercial burglary. Soliz was originally granted formal probation. He violated his probation in this case as a result of his new charges in case NCR78936. Victim reported he opened a bank account and deposited $3,900. When he did not receive his ATM card in the mail he contact- ed the bank who stated he was overdrawn. After an investigation into the inci- dent it was determined the bank had mailed the ATM card and PIN number to the victim’s former address, where the defendant now lives. Defendant was caught on surveillance video using the stolen ATM card. • Ricky Tosh Eusted was sentenced to two years in state prison for possession of a controlled substance. Eusted was originally granted formal probation. He violated his probation when he failed to contact the probation department and report to his drug and alcohol treatment program as ordered. • Curtis John Ables Sr., was sentenced to 16 months in state prison for receiving stolen property; failure to appear while on bail. Ables was originally granted formal probation. He violated his probation when he tested positive for the use of marijuana. Recent County Jail Commitments: • Marian Lynn Kindrick was sentenced to 365 days in Tehama County Jail for aid by misrepresentation- over $400. Kindrick was originally granted formal probation. She violated her probation when she failed to keep probation informed of her contact information and failed to complete drug and alcohol treatment as ordered. • Tammy Sue Dawn Kelly was sentenced to 120 days in Tehama County Jail for possession of a con- trolled substance. Kelly was originally granted formal probation. She violated her probation when she was caught steal- ing items from a store in Chico. Recent Proposition 36 Commitments: Note: All cases wherein a defendant is sentenced per the terms of Proposition 36 are not at the request of the Tehama County District Attorney’s Office. Per the requirements of Proposi- tion 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on proba- tion and require drug treat- ment alone. Per the require- ments of Proposition 36, only upon a third drug relat- ed probation violation may the court impose confine- ment time. In the event the defendant violates a non- drug related term of proba- tion the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney’s Office contends that each criminal case is unique and that in certain, specific, cases a defendant should be sen- tenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a his- tory of non-compliance with either previous grants of probation or previous grants of drug treatment, a state prison sentence should properly be imposed. • Sean Timothy Silos was sentenced to prop. 36 probation for possession of a controlled substance. Agents conducted a parole search of a resi- dence. Silos was located inside the residence along with six Oxycontin pills and burnt tin foil which were found inside his bed- room. Preliminary Hearings (PX) and Trials: • Joseph Dailey Froome will appear in court at 9 a.m. on July 14. He is fac- ing the charges of cultivat- ing marijuana; possession of marijuana for sale, eight counts of money launder- ing. Agents served a search warrant at the Froome’s warehouse off of Baker Road in Red Bluff. Inside they found over 400 mari- juana plants. TIDE agents also located over 30 pounds of processed mari- juana. • Daniel Miguel Ludwig will appear in court at 9 a.m. on July 14. He is fac- ing the charges of cultivat- ing marijuana; possession of marijuana for sale. Agents served a search warrant at the Froome’s warehouse off of Baker Road in Red Bluff. Inside they found over 400 mari- juana plants. TIDE agents also located over 30 pounds of processed mari- juana. • Michael Bruce Pryor Jr., will appear in court at 9 a.m. on Aug. 12. He is fac- ing the charges of cultivat- ing marijuana; possession of marijuana for sale. Agents served search warrants at the properties and businesses operated by the Pryors. Agents found 191 growing marijuana plants. Inside the business- es agents also found several recommendations which were all fraudulent and one of which was stolen. All three defendants were arrested and booked into the Tehama County Jail.
