Monday, May 10, 2010 – Daily News – 3B The following defen- dants were sentenced in Tehama County Superior Court, according to the Tehama County District Attorney’s Office: —————— Recent State Prison Commitments: • Kenneth Lamar Jenk- ins was sentenced to 11 years in state prison for false personation, pimp- ing, special allegation- prior felony, two counts. Officers conducted a traffic stop on Jenkins’ vehicle. Upon contacting Jenkins he was unable to provide identification and stated his name was Bryson Harper. Officers received consent to search Jenkins’ vehicle which then lead officers to obtain consent to search the hotel room in which Jenkins was staying. Upon arriv- ing at the hotel room offi- cers found a seventeen year old girl as well as nude pictures of the minor on Jenkins’ cell phone and computer. Upon ques- tioning Jenkins he denied knowing the minor was underage as well as deny- ing he was a pimp. Offi- cers later determined Jenkins’ real identity to be Kenneth Lamar Jenkins. They also determined that over the last number of months he had been the pimp for the girl and another female. • Joseph Pascual Mar- COURT ROUND-UP • Eulices Rodriguez tinez was sentenced to five years in state prison for unlawful driving or taking of a vehicle with special allegations-prior auto theft conviction,-prior felony. The victim exited his vehicle and left it running while he went inside a store. As the victim was inside the store he noticed Martinez get inside his vehicle and drive away. A short time later officers located Martinez in the stolen vehicle and took him into custody. • Manuel Valencia was sentenced to three years, eight months in state prison for possession of a controlled substance. Valencia was originally granted formal probation. Valencia violated his pro- bation when he failed to appear in court on revoca- tion hearings. • Joseph Ray Veaver was sentenced to two years, eight months in state prison for posses- sion of a controlled sub- stance; possession of a controlled substance. Veaver was originally granted formal probation on both cases. Veaver vio- lated his probation when he left his court ordered drug treatment program and failed to contact pro- bation regarding his whereabouts. was sentenced to 16 months in state prison for false imprisonment by violence. Rodriguez was origi- nally granted formal pro- bation. Rodriguez violat- ed his probation when he failed to keep probation informed of his contact information and failed to stay away from victim and victim’s family as ordered. • Eric Wayne McDon- ald was sentenced to an additional eight months in state prison for possession of a controlled substance. McDonald was origi- nally granted formal pro- bation. McDonald violat- ed his probation when he tested positive methamphetamine. for Recent County Jail Commitments: • Marian Lynn Kin- drick was sentenced to 128 days in Tehama County Jail for aid by misrepresentation-Over $400. Kindrick was original- ly granted formal proba- tion. Kindrick violated her probation when a search of Kindrick’s home revealed several empty bottles of Vodka and beer. • Lionel Martinez was sentenced to 90 days in Tehama County Jail for first degree residential burglary. Martinez was original- ly granted formal proba- tion. Martinez violated his probation when he failed to appear at probation as ordered. • Richard Wayne Lakin was sentenced to 60 days in Tehama County Jail for child abuse. Lakin was originally granted formal probation. Lakin violated his proba- tion when he was found in possession of marijuana as well as submitting a urine sample that tested positive for the use of marijuana. Recent Proposition 36 Commitments: Note: All cases where- in a defendant is sen- tenced per the terms of Proposition 36 are not at the request of the Tehama County District Attor- ney’s Office. Per the requirements of Proposi- tion 36, a defendant who possesses drugs cannot be sentenced to confinement time in jail or prison. Instead, the court must place defendant on proba- tion and require drug treatment alone. Per the requirements of Proposi- tion 36, only upon a third drug related probation violation may the court impose confinement time. In the event the defendant violates a non-drug relat- ed term of probation the court may then elect to sentence defendant to jail or prison. The Tehama County District Attorney’s Office contends that each crimi- nal case is unique and that in certain, specific, cases a defendant should be sen- tenced to a combination of drug treatment and jail time. We further contend that in other specific cases where a defendant has an extensive criminal record and/or a history of non- compliance with either previous grants of proba- tion or previous grants of drug treatment, a state prison sentence should properly be imposed. • James Donald Procar- ione was sentenced to Prop. 36 probation for possession of a controlled substance. Procarione was in cus- tody at the Tehama Coun- ty Jail when a small bag of methamphetamine was located in his sock during a strip search conducted by officers. • Christine Marie Gre- gory was sentenced to Prop. 36 probation for transportation of a con- trolled substance, posses- sion of a controlled sub- stance. Brief history: During a search of Gregory’s resi- dence and vehicle agents from the drug task force located 2.6 grams of methamphetamine, scales, and hydrocodine pills. Preliminary Hearings (PX) and Trials: 20. TCSO - People vs. Jose Guadalupe Ramirez and Elfego Chavez Aceve- do aka Elfego Acevedo Chavez will appear in court at 9 a.m. on July 13. Ramirez and Chavez are facing the charges of car- jacking, second degree robbery, kidnapping for carjacking, each charge with a special allegation of use of firearm. A Tehama County man received a phone call from a friend requesting a ride from Redding back to Red Bluff for her "two cousins". The Red Bluff man agreed and drove to Redding to meet with all three people. The Victim’s friend and her "two cousins" got into the Vic- tim’s car and traveled toward Tehama County based on the directions provided by Ramirez. The victim stopped his car and Ramirez puts a gun to the victim’s head and demanded the car and ordering him out. Aceve- do prones the victim out on the ground and stole his wallet and cell phone. About four hours later, Red Bluff Police Depart- ment officers located and stopped the stolen car and arrested Ramirez. Aceve- do fled but was eventually arrested.
