If this person gets discharged from the military, call and we will LEGAL NOTICE RESOLUTION NO. 39-2012 A RESOLUTION OF INTENTION TO LEVY A FISCAL YEAR ASSESSMENT FOR THE DOWNTOWN RED BLUFF PARKING AND BUSINESS IMPROVEMENT AREA. The City Council of the City of Red Bluff approves the report for the Downtown Red Bluff Parking and Business Improvement Area submitted by Downtown Red Bluff Business Association and adopts the following resolution of intention: 1. It is the intention of the City Council to retain the same boundaries of the parking and business improvement area and the same benefit zones within the area as were in place during the previous fiscal year. 2. It is the intention of the City Council to levy and collect assessments within the existing parking and business improvement area for the fiscal year. There shall be no change in the dollar amount of assessments from the previous fiscal year. 3. The improvements and activities authorized by Ordinance No. 869 and Resolution No. 16-1995 are as follows: Improvements: Seasonal and other decorations; decorative street lighting; beautification plantings; parking facilities; benches; fountains; outside music; and trash receptacles. Activities: The promotion of public events which benefit businesses in the Area and which take place on or in public places within the Area, including festivals, parades, fairs and concerts; the furnishing of music in any public place within the Area; activities which benefit businesses located and operating within the Area; the promotion of tourism within the Area. No substantial changes are proposed to be made to the improvements and activities. 4. The name of the Parking and Business Improvement Area is the Downtown Red Bluff Parking and Business Improvement Area. The location of the Area is a portion of the City of Red Bluff as set forth in Schedule A of this resolution attached hereto and by such reference made a part hereof. The location of the ���benefit zones��� within the Area is also shown in Schedule A. Every written protest shall be filed with the clerk at or before the time fixed for the public hearing. The City Council may waive any irregularity in the form or content of any written protest and at the public hearing may correct minor defects in the proceedings. A written protest may be withdrawn in writing at any time before the conclusion of the public hearing. Each written protest shall contain a description of the business in which the person subscribing the protest is interested sufficient to identify the business and, if a person subscribing is not shown on the official records of the city as the owner of the business, the protest shall contain or be accompanied by written evidence that the person subscribing is the owner of the business. A written protest, which does not comply with this section, shall not be counted in determining a majority protest. If written protests are received from the owners of businesses in the proposed area which will pay 50 percent or more of the assessments proposed to be levied and protests are not withdrawn so as to reduce the protests to less than that 50 percent, no further proceedings to levy the proposed assessment, as contained in the Resolution of Intention, shall be taken for a period of one year from the date of the finding of a majority protest by the City Council. 7. The time and place for the public hearing to be held by the City Council on the levy of the proposed assessment for the fiscal year shall be January 15, 2013, at 7 p.m. at the City Council Chambers, 555 Washington Street, Red Bluff California. At this hearing, the testimony of all interested parties for or against the levy of the assessments for the fiscal year shall be heard. This report sets forth a full and detailed description of the improvements and activities to be provided for the fiscal year, any proposed boundary changes of the Area and any proposed zone changes within the Area and the proposed assessments to be levied upon the businesses within the Area for the fiscal year. 6. At the public hearing, the city council shall hear and consider all protests against the levying of assessments within the area. A protest may be made orally or in writing by any interested person. Any protest pertaining to the regularity or sufficiency of the proceedings shall be in writing and shall clearly set forth the irregularity or defect to which the objection is made.
